Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve the purchase of four desktop personal computers from Gateway in an amount not to exceed $7,300.  Motion carried unanimously, with Supervisor Dorame absent.

Integ. Waste/ 2002 Solid Waste Permits

Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve the issuance of a 2002 Solid Waste Collection/Transportation Permit to Bishop Waste Disposal, Inc., (Area A), Sierra Disposal, Inc., (Area B), Benz Sanitation (Areas C & F), Pahrump Valley Disposal (Areas D & E), and M.P. Environmental (Area F) to operate in Inyo County; and authorize the Deputy County Administrator to sign the permits.  Motion carried unanimously, with Supervisor Dorame absent.

Resol. #2002-01/ 6^th Cycle Used Oil Grant

On a motion by Supervisor Lent and a second by Supervisor Arcularius, Resolution No. 2002-01 entitled “Resolution of the Board of Supervisors, County of Inyo, State of California, Authorizing the California Integrated Waste Management Board to Administer the California Oil Recycling Enhancement Act on Behalf of the County” and authorizing the Environmental Services Joint Powers Authority to submit to the California Integrated Waste Management Board a regional application for the Local Government Used Oil Opportunity – Sixth Cycle on behalf of the County, was enacted: motion unanimously passed and adopted with Supervisor Dorame absent.

Parks/R. Allen Committee Appointment

Moved by Supervisor Lent and seconded by Supervisor Arcularius to appoint Rex Allen as the Third District Representative to the Park Advisory Committee to complete a two-year term ending November 7, 2003.  Motion carried unanimously, with Supervisor Dorame absent.

CAO-Purchasing/ .25% Sale Tax Increase

Moved by Supervisor Lent and seconded by Supervisor Arcularius to authorize the Purchasing Agent to approve any purchase order amounts previously approved by your board with a “not to exceed amount” which require an adjustment to reflect the increase in the Inyo County Sales Tax Rate from 7.50% to 7.75% effective January 1, 2002.  Motion carried unanimously, with Supervisor Dorame absent.

CAO-Purchasing/ Avalanche Monitoring

Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve the purchase of avalanche monitoring services from Snow Survey Associates in an amount not to exceed $3,000.  Motion carried unanimously, with Supervisor Dorame absent.

H&H-EMS/ Declaration Not to Apply for EMS

Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve the “Declaration of Intent Not to Apply” for the FY 2001/02 Emergency Medical Services appropriation and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Dorame absent.

H&H-Health Serv./Delta Dental Contract Amendment

Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve Amendment No. 2 to the Contract between the County of Inyo and Delta Dental Plan of California increasing the amount of the Contract by $12,500, for case management and development/implementation of procedures for the collaboration of Inyo County Family Dental and Mammoth Rural Health Clinic Dental Services; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Dorame absent.

P.W./Inyo Mono Transit Office Lease

Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve the facility Lease Agreement between the County of Inyo and David A. Hasle for Inyo Mono Transit Office located at 210 South Warren Street at the rate of $600 per month, for the period of December 1, 2001, through November 30, 2004, contingent upon the Board’s adoption of future budgets; and authorize the Chairperson to sign, contingent upon the appropriate signatures being obtained.  Motion carried unanimously, with Supervisor Dorame absent.

P.W./Backup Generator P.O.

Moved by Supervisor Lent and seconded by Supervisor Arcularius to award and approve the purchase of one 17kw, LPG – powered, emergency backup generator, from Kohler Power Systems of Fallon, Nevada, in an amount not to exceed $11,067.13.  Motion carried unanimously, with Supervisor Dorame absent.

Resol. #2002-02/ Parks Vault Toilet Improvements

On a motion by Supervisor Lent and a second by Supervisor Arcularius, Resolution No. 2002-02 was adopted, accepting the improvements and authorizing the recording of a Notice of Completion for the Inyo County Parks and Recreation Vault Toilet Improvements: motion unanimously passed and adopted, with Supervisor Dorame absent.

P.W./Cascade Software Contract

Moved by Supervisor Lent and seconded by Supervisor Arcularius to approve the Contract between the County of Inyo and Cascade Software for the final design, development and implementation of the new Building & Maintenance software module for the upgrading of our existing Cost Accounting System for Quarterly Cost Applied Billings to all non-general fund departments, in an amount not to exceed $15,000; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Dorame absent.

Integ. Waste/ Budget Amendment

Moved by Supervisor Hambelton and seconded by Supervisor Lent to amend the FY 2001/02 Used Oil Recycling Grant – Seventh Cycle, Budget Unit 640108 by increasing estimated revenue in State Grants (Object Code #4498) by $15,900 and increasing appropriations in Advertising (Object Code #5263) by $5,500 and Professional Services (Object Code #5265) by $10,400.  Motion carried unanimously, with Supervisor Dorame absent.

Planning Dept.- Yucca Mnt./ Certifying Funds

Moved by Supervisor Lent and seconded by Supervisor Hambleton to ratify the Chairperson’s signature on the corrected form certifying that the funds expended by Inyo County through the Yucca Mountain Repository Assessment Office for County Fiscal Year 2000-2001 were for activities as defined by the Nuclear Waste Policy Act of 1982, as amended and the Energy and Water Development Act of 2001.  Motion carried unanimously, with Supervisor Dorame absent.

P.W.-Bishop A/P/ Furnishing New Airport Terminal Restaurant

The Board and Staff discussed the various options concerning the furnishing of the new Airport Terminal Restaurant.  Mr. Jeff Jewett, the Public Works Director, informed the Board that with regard to furnishing the seating area of the restaurant he was recommending that this be included for discussion with the Operator once the RFP process is concluded.  The Board and Staff discussed certain aspects of the RFP for the operation of the Restaurant, with the Board indicating they did not want to subsidize the restaurant.  Moved by Supervisor Hambleton and seconded by Supervisor Arcularius to A) authorize the purchase of kitchen equipment as recommended by the Public Works Department for the newly constructed restaurant at the Bishop Airport Terminal Building; B) amend the FY 2001/2002 County Budget by appropriating $35,000 from Contingencies and authorize the County Administrator and the Auditor-Controller to make the appropriate budget adjustments to the Bishop Airport Terminal Construction Budget Unit 150102; and C) direct the Public Works Department to furnish and equip the seating area of the restaurant as recommended by the Public Works Director.  Motion carried unanimously, with Supervisor Dorame absent.

BofS/Minute Approval

Moved by Supervisor Arcularius and seconded by Supervisor Lent to approve the minutes of the November 19, 2001, Board of Supervisors Meeting.  Motion carried unanimously on a three-to-zero vote, with Supervisors Arcularius, Bear, and Hambleton voting yes, with Supervisor Lent abstaining and with Supervisor Dorame absent.

Moved by Supervisor Hambleton and seconded by Supervisor Lent to approve the minutes of the December 11, 2001, Board of Supervisors Meeting.  Motion carried unanimously on a three-to-zero vote, with Supervisors Bear, Lent and Hambleton voting yes, with Supervisor Arcularius abstaining and with Supervisor Dorame absent.

P.W.-Town Water System/Plans & Specs-L.P. Phase I & Indy Phase II 

Moved by Supervisor Hambleton and seconded by Supervisor Lent to approve the Plans and Specifications for Phase II of the Independence Water System Upgrade and Phase I of the Lone Pine Water System Upgrade and authorize the Public Works Director to advertise for bids for the project.  Motion carried unanimously, with Supervisor Dorame absent.

Probation Workshop

The Chairperson announced that the workshop scheduled with the Probation Department on the role of the Juvenile Center has been postponed.

Water/W/S/DWP Drought Recovery

The Chairperson recessed open session at 10:10 a.m., to convene in a workshop, with all Board Members present except Supervisor Dorame to receive a presentation from the City of Los Angeles Department of Water and Power on their Drought Recovery Policy.

The Chairperson recessed the workshop at 11:25 a.m., to convene in open session and immediately recess for the lunch break.  The Board reconvened at 12:35 p.m., in closed session with all Board Members present.

Closed Session

Supervisor Dorame joined the meeting at 12:35 p.m. for closed session.  The Board met in closed session to discuss Agenda Items No. 22. CONFERENCE WITH LEGAL COUNSEL – EXISTING/ANTICIPATED LITIGATION [Pursuant to Government Code §54956.9(a)(c)]. One Case - Laws/McNally Canals Dispute between LADWP and County Inyo, Adjudication of Dispute  Pursuant to the Long Term Water Agreement entered June 1997 as Stipulation and Order for Judgment, Inyo County Superior Court,  Case No.  12908; No. 23. The Chairperson recessed closed session at 5:17 p.m., to convene in open session to receive a report on closed session.   County Counsel reported with regard to Agenda Item No. 24. CONFERENCE WITH LABOR NEGOTIATOR [Pursuant to Government Code §54957.6] - Instructions to Negotiators re: Wages, salaries and benefits -Title: Director of Environmental Health – Negotiator: member of Board of Supervisors as designated, the Board has appointed Mr. Robert Hurd as the Director of Environmental Health at the salary of $6,000 per month, with a Contract to be presented for final approval.
