The Board of
Supervisors of the County of Inyo, State of California, met in regular session
at the hour of 9:10 a.m., on Tuesday,
February 5, 2002, in the Board of Supervisors Room, County Administrative
Center, Independence, with the following Supervisors present:
Chairperson Linda Arcularius presiding, Julie Bear, Ervin R. Lent, and
Michael Dorame. Supervisor
Hambleton was absent. Supervisor
Dorame provided the Invocation, and Supervisor Lent led the Pledge of Allegiance.

Public
Comment
|
The
Chairperson announced the public comment period.
Ms. Kathy White, Independence Chamber of Commerce, provided a copy
of the brochure envelopes which each Chamber is using at the Travel shows
and invited the Board to drop by the Lions Club House to view the travel
booth which is being displayed during the noon hour. Sheriff Lucas updated the Board on the Search and Rescue
operations. Ms. Jean
Dickinson, Assistant Director of Health & Human Services, informed the
Board that the comments made in a “Letter to the Editor” in the Inyo
Register were made by a group who is not known to nor has had any direct
dealings with the County Staff. Ms.
Dickinson commended the Health & Human Services Staff for the
excellent, caring job they do.

Moved by
Supervisor Lent and seconded by Supervisor Bear to award the quotation for
and authorize the purchase of 160 cartons of 8-1/2” x 11” copier paper
to the lowest qualified bidder, as determined by Staff, from quotations
due on February 7, 2002. Motion
carried unanimously, with Supervisor Hambleton absent.

Computer Purchases

Moved by
Supervisor Lent and seconded by Supervisor Bear to approve the purchase of
desktop computers for various departments through the WSCA Contract
System, from Gateway Business of North Sioux City, South Dakota, in an
amount not to exceed $28,470, plus applicable taxes and delivery. Motion carried unanimously, with Supervisor Hambleton
absent.

Campground Lease
|
Moved by
Supervisor Lent and seconded by Supervisor Bear to approve the lease
between the County of Inyo and the City of Los Angeles, Department of
Water and Power for the Pleasant Valley Campground property for the period
of July 1, 2001, through June 30, 2006, at the rate of $360 per year; and
authorize the Chairperson to sign. Motion
carried unanimously, with Supervisor Hambleton absent.

Moved by
Supervisor Lent and seconded by Supervisor Bear to approve a 90 day
leave-of-absence without pay for a County employee, for the period of
February 6, 2002 through May 6, 2002, in accordance with the Inyo County
Personnel Rules and Regulations. Motion
carried unanimously, with Supervisor Hambleton absent.

Serv./Children’s Trust Fund Annual Receipts
|
Moved by
Supervisor Lent and seconded by Supervisor Bear to A) name the Inyo County
Children’s Services Council as the local voluntary council to carry out
the purposes of Welfare and Institutions Code Section 18965 et al; and B)
require that the Children’s Trust Fund annual receipts be used to
benefit children and families countywide, based on a formula linked to
funding from the Office of Child Abuse Prevention, as recommended by
Staff. Motion carried unanimously, with Supervisor Hambleton
absent.

Moved by
Supervisor Lent and seconded by Supervisor Bear to approve Amendment No. 1
to the Contract between the County of Inyo and Maxwell & Hallis, LLP
for the provision of professional accounting, reporting and consultation
services for the period of July 1, 2001, through June 30, 2002, increasing
the amount by $3,000 to an amount not to exceed $10,000; and authorize the
Chairperson to sign. Motion
carried unanimously, with Supervisor Hambleton absent.

Bear to approve Parcel Map #333 and acceptance of the Offer of Dedication

Dept./ $5-million DOE Research Grant
|
Moved by
Supervisor Dorame and seconded by Supervisor Lent to approve the submittal
of the application for a U.S. Department of Energy Research Grant for a
three-year hydrologic research program in an amount not to exceed
$5,000,000 and designate the Planning Director to sign the grant
application and any other documents required to facilitate the
application, on behalf of the County.
Motion carried unanimously, with Supervisor Hambleton absent.

Hlth/Monitoring Plan Report
|
Dr. Gail
Zwier, Director of Behavioral Health Services presented and reviewed in
detail and at length the October and November, 2001, Mental Health
Continuous Data Monitoring Plan Report.
Additionally, Dr. Zwier, briefly reviewed preliminary statistics
for January, 2002.

1050/ Wireless Service Facilities
|
The
Chairperson opened the public hearing, at 10:05 a.m., to consider the
enactment of an ordinance entitled “An Ordinance of the Board of
Supervisors of the County of Inyo, State of California, enacted as an
Interim Urgency Measure pursuant to Section 65858 of the Government Code,
instituting Interim Regulations on Siting and Construction of Wireless
Service Facilities in Open Space, Residential and Commercial Zoning
Districts of the County” which
will extend the standards in Ordinance No. 1039 for three months.
The Planning Director reviewed the Staff Report and recommendations
regarding the proposed interim ordinance.
He explained why this interim ordinance was being proposed and the
time-line for the adoption of a permanent ordinance.
There being no one from the public wishing to comment on this item,
the Chairperson closed the public hearing at 10:15 a.m.
Moved by
Supervisor Dorame and seconded by Supervisor Lent to find that the
adoption of the interim ordinance extending the standards in Ordinance
1039 is an action taken by a regulatory agency for protection of a natural
resource and of the environment and to be exempt from the requirements of
the California Quality Act (CEQA) pursuant to Sections 15307 and 15308,
respectively, of the CEQA Guidelines.
Motion carried unanimously, with Supervisor Hambleton absent.
On a
motion by Supervisor Dorame and a second by Supervisor Lent, Ordinance No.
1050 entitled “An Ordinance of the Board of Supervisors of the County of
Inyo, State of California, Enacted as an Interim Urgency Measure pursuant
to Section 65858 of the Government Code, Instituting Interim Regulations
on Siting and Construction of Wireless Service Facilities in Open Space,
Residential and Commercial Zoning Districts of the County”
was adopted: motion unanimously passed and adopted, with Supervisor
Hambleton absent.

Planning
Dept./ Ordinance on Wireless Service Facilities
|
The
Chairperson announced that the request by the Planning Department for the
Board to A) conduct a public hearing on a proposed ordinance entitled
“An Ordinance of the Board of Supervisors of the County of Inyo, State
of California, adding Chapter 18.76 to the Inyo County Code relative to
Wireless Communications Facilities, Amending Title 18 of the Inyo County
Code and Repealing the Interim Ordinance;” and B) at the conclusion of
the public input on this proposed ordinance continue the Public Hearing to
10:05 a.m., February 19, 2002, in the Board of Supervisors Room, at the
County Administrative Center, in Independence, had been pulled from the
Agenda at the request of the Department.

Contract Managed Care Services

Moved by
Supervisor Bear and seconded by Supervisor Lent to ratify the Contract
between the County of Inyo and the State of California Department of
Mental Health for managed care services for the period of July 1, 2001,
through June 30, 2002, in an amount not to exceed $102,573; and authorize
the Chairperson to sign. Motion
carried unanimously, with Supervisor Hambleton absent.

CAO/Policy on Placement of
Plaques on and Naming of County Facilities
|
The County
Administrator presented the proposed policy establishing the criteria for
evaluating requests for naming or placing plaques on County owned
facilities. The Board took a
few moments to review the policy. The
Board and Mr. Mendez discussed the policy, with the County Administrator
explaining that there are several requests which may be forthcoming
regarding the naming or placement of plaques at the Bishop Airport.
Supervisor Dorame asked that under Section II, No. 2., the word
“and” be replaced by “and/or.” Additionally the County Administrator indicated that the
word commemorate in Sections IV and V should be changed to commemorative.
Moved by Supervisor Bear and seconded by Supervisor Dorame to
accept and approve the policy, as amended, setting the criteria for
evaluating requests for naming or placing plaques on County owned
facilities. Motion carried
unanimously, with Supervisor Hambleton absent.

The Chairperson recessed the regular meeting at
10:30 a.m., reconvening at 10:40 a.m., with all Board Members present,
except Supervisor Hambleton.

Parks/Improve-
ment Plan Update and Tennis
Court Improvement Project
|
The Deputy County Administrator reviewed the Staff
report and information provided in the Park Improvement Plan Project
Status Report and Usage and Revenue Analysis.
Supervisor Lent asked that Mr. Hamilton look into improvements at
Isaac Walton Park, including repairs to the bridge. The Board and Staff discussed in detail the information
provided by Mr. Hamilton and at the end of his verbal presentation, Mr.
Hamilton presented a brief slide presentation, showing pictures of the
various improvements at the Parks and Campgrounds. The Board and Staff also discussed Staff’s
recommendations regarding the tennis courts located at various County
Parks. Moved by Supervisor
Dorame and seconded by Supervisor Lent to accept the Staff’s
recommendations for the Tennis Court Improvement Project. Motion
carried unanimously, with Supervisor Hambleton absent.

by Supervisor Bear and seconded by Supervisor Dorame to approve the
Minutes of the January 15, 2002, Board of Supervisors Meeting.
Motion carried unanimously, with Supervisor Hambleton absent.

Fish & Game/ Fine Fund
Expenditure
|
Moved by
Supervisor Lent and seconded by Supervisor Dorame to approve a $2,000
expenditure from the Fish and Game Fine Fund to go towards the purchase of
one 400 gallon guzzler to add capacity to an existing 1,000 gallon
wildlife water system and 55 gallon drinker units, tank floats, stainless
steel drinking trays, plumbing and other material needed for new watering
sources. Motion carried
unanimously, with Supervisor Hambleton absent.

|
The Chairperson recessed open session at 12:10
p.m., reconvening at 1:30 p.m., with all Board Members present, except
Supervisor Hambleton.

Board Members and Staff
Reports
|
The Board
Members reported on their activities during the preceding week, including
constituent meetings, a meeting with the Bishop Tribe concerning Animal
Control, upcoming Arts Council and Children and Families Commission
meetings, and the RCRC Meeting and the Induction of Officers at which time
Supervisor Linda Arcularius assumed the office of Chairperson of RCRC.
The County Administrator notified the Board that the Forest Service
Payment had been received and the Schools’ portion had been
inadvertently paid without the required public input process being
followed. Mr. Mendez
explained that while the Board had declared their intention to share the
money with the Schools the public input process had to be followed prior
to distribution of the funds. He
indicated that the Schools would return the money, and the money would not
be redistributed until all requirements had been met.
Mr. Mendez also informed the Board that next Tuesday, February 12,
2002, is a County Holiday and that no Board Meeting is scheduled for that
day. Mr. Mendez also informed the Board that he would be traveling to St.
George, Utah, to meet with the SkyWest Organization about the Bishop
Airport.

|
The
Chairperson recessed open session at 2:20 p.m., to convene in closed
session, with all Board Members present, except Supervisor Hambleton to
discuss Agenda Item No. 20. CONFERENCE WITH LABOR NEGOTIATOR
(Pursuant to Government Code Section 54957.6) – Instructions to
Negotiators re: wages, salaries and benefits – Title – ICEA –
Negotiator – County Administrative Officer & Personnel Analyst.

Report on Closed
Session
|
The
Chairperson recessed closed session at 3:45 p.m., to convene in open
session to receive a report on closed session.
County Counsel reported there were no items discussed in closed
session which were required by law to be reported on in open session.

Adjournment
|
The
Chairperson adjourned the regular meeting at 3:45 p.m., to 9:00 a.m.,
February 19, 2002, in the Board of Supervisors Room, at the County
Administrative Center in Independence.
