The Board of
Supervisors of the County of Inyo, State of California, met in regular session
at the hour of 9:10 a.m., on Tuesday,
March 26, 2002, in the Board of Supervisors Room, County Administrative
Center, Independence, with the following Supervisors present:
Chairperson Linda Arcularius presiding, Ervin R. Lent, Carroll M.
Hambleton, Jr., and Michael Dorame. Supervisor
Bear was absent. Supervisor Lent
provided the Invocation, and Supervisor Dorame led the Pledge of Allegiance.

Public Comment
|
The
Chairperson announced the public comment period.
Environmental Health Director, Robert Hurd, informed the Board of
an upcoming CalEPA Meeting which will be held April 3, 2002, in the Board
of Supervisors Room, at the County Administrative Center, in Independence,
to consider a CUPA designation for the County.
Mr. Andrew Remus, Yucca Mountain Project Coordinator, informed the
Board of the award of the DOE grant for Inyo County to perform hydrologic
studies in the Death Valley Area. Mr.
Remus also informed the Board that the DOE has fast tracked this grant and
funds will be available this fiscal year.

Moved by
Supervisor Dorame and seconded by Supervisor Lent to approve a purchase
order to Nielsen’s Equipment Maintenance in an amount not to exceed
$20,540.74 for the equipping of five (5) Sheriff’s Department vehicles.
Motion carried unanimously, with Supervisor Bear absent.

Resol. #2002-17/ 8th
Cycle Waste Oil Grant
|
On a
motion by Supervisor Dorame and a second by Supervisor Lent, Resolution
No. 2002-17 was adopted to allow Inyo County to participate in the Waste
Oil Recycling Grant – Eighth Cycle for the period of 2002 through 2005: motion unanimously passed and adopted, with Supervisor Bear
absent.

Moved by Supervisor Dorame and seconded by Supervisor
Lent to award Bid No. 2001-13 for and approve the purchase of a mobile
office from Martin Container, Inc., in an amount not to exceed $7,503.52.
Motion carried unanimously, with Supervisor Bear absent.

Moved by
Supervisor Dorame and seconded by Supervisor Lent to approve the purchase
of mosquito abatement chemicals as recommended by Staff from Fennimore
Chemicals, Inc., in an amount not to exceed $4,994.21.
Motion carried unanimously, with Supervisor Bear absent.

Moved by
Supervisor Dorame and seconded by Supervisor Lent to appoint Betty Hinga
and Sharon Partridge to the Mental Health Board to complete unexpired
terms ending June 30, 2003. Motion
carried unanimously, with Supervisor Bear absent.

otranspiration Equipment

Moved by
Supervisor Dorame and seconded by Supervisor Lent to declare Campbell
Scientific Systems as the sole-source provider of evapotranspiration
equipment and approve the purchase of two eddy correlation (EC) systems
from Campbell Scientific Systems in an amount not to exceed $44,966.18,
plus tax and shipping. Motion
carried unanimously, with Supervisor Bear absent.

Auditor/Fixed Asset Policy
|
Moved by
Supervisor Lent and seconded by Supervisor Hambleton to adopt the “Fixed
Asset Policy” which will establish $1,000 as the amount at which Inyo
County will capitalize its equipment, and establish procedures for
maintaining the “Fixed Asset Inventory” and authorize the
Auditor-Controller to remove from the existing “Fixed Asset Inventory”
all equipment that has a historical value of less than $1,000.
Motion carried unanimously, with Supervisor Bear absent.

Clerk-Election/ Statement of
Votes Cast
|
Moved by
Supervisor Dorame and seconded by Supervisor Lent to accept the Statement
of All Votes Cast at the Consolidated Primary Election held March 5, 2002
and declare elected those offices and declare passed or failed those
measures under their jurisdiction for this election, according to the
number of votes for each as shown on the Statement of All Votes Cast.
Motion carried unanimously, with Supervisor Bear absent.

Rd. Dept./Ft. Indy Road
Resurfacing
|
The Public
Works Director, Jeff Jewett, provided the Board with a recap of the bids
submitted for the Ft. Independence Road Resurfacing Project and
recommended the Board award the contract for this project to the low
bidder, Reid Construction in the amount of $229,750.
The Board and Mr. Jewett discussed other STIP Projects, with Mr.
Jewett indicating that his department is working aggressively to meet the
deadlines for the projects. Mr.
Jewett also informed the Board that he would be approaching the local LTC
to fund a Pavement Management position.
Moved by Supervisor Hambleton and seconded by Supervisor Dorame to
award the bid and approve the Contract for the Ft. Independence Road
Resurfacing Project to Reid Construction in the amount of $229,750;
authorize the Chairperson to sign contingent upon the appropriate
signatures being obtained; and authorize the Public Works Director to
execute all other contract documents, including contract change orders, to
the extent permitted by Public Contract Code Section 20142, and other
applicable law. Motion
carried unanimously, with Supervisor Bear absent.

BofS/Minute Approval
|
The Clerk requested the Board amend the minutes of
the March 12, 2002, Board of Supervisors Meeting by add the name Sierra
Trout Foundation in reference to the Friends of the Sierra Trout in the
first paragraph of page three. Moved
by Supervisor Dorame and seconded by Supervisor Hambleton to approve the
minutes of the March 12, 2002, Board of Supervisors Meeting as amended.
Motion carried unanimously on a three-to-zero vote, with
Supervisors Arcularius, Hambleton and Dorame voting yes, with Supervisor
Lent abstaining and with Supervisor Bear absent.

BofS/Proclaiming Cesar
Chavez Day
|
The County
Administrator reviewed the request to proclaim April 1, 2002, as Cesar
Chavez Day in Inyo County, commending the works of Cesar Chavez and
supporting the proclamation. Moved
by Supervisor Dorame and seconded by Supervisor Hambleton to proclaim
April 1, 2002, as Cesar Chavez Day of Service and Learning in Inyo County.
Motion carried unanimously, with Supervisor Bear absent.

Reports
|
The Board Members reported on their activities
during the preceding week, including constituent meetings, the CSAC
Legislative Conference, an Interagency Visitor’s Center Board Meeting,
the LTC Meeting, the upcoming PUC Meeting, with Supervisor Lent providing
a detaied report on his trip to Washington, D.C. for the NACo Conference.

Reconvene
|
The
Chairperson announced that Agenda Item No. 12. CONFERENCE
WITH LABOR NEGOTIATOR (Pursuant to Government Code Section 54957.6) - Instructions
to Negotiators re: wages, salaries and benefits – Title: ICEA –
Negotiator – County Administrator and Personnel Analyst, would not be
discussed in closed session. The
Chairperson recessed the regular meeting at 11:50 a.m., reconvening at
1:00 p.m., in closed session, with all Board Members present, except
Supervisor Bear.

Closed Session
|
The Board
met in closed session to discuss Agenda Item No. 13. PERSONNEL (Pursuant to
Government Code Section 54957)– Public Employee Performance
Evaluation – Title: Director
of Water Department.

Report on Closed Session
|
The
Chairperson recessed closed session at 2:30 p.m., to reconvene in open
session to receive a report on closed session.
County Counsel reported there were no items discussed in closed
session which were required by law to be reported on in open session.

Adjournment
|
The
Chairperson adjourned the regular meeting at 2:30 p.m., to 9:00 a.m.,
Tuesday, April 1, 2002, in the Board of Supervisors Room, at the County
Administrative Center in Independence.
