The Board of Supervisors of the County of Inyo, State of
California, met in regular session at the hour of 9:15 a.m., on Tuesday,
September 10, 2002, in the Board of Supervisors Room, County
Administrative Center, Independence, with the following Supervisors present:
Chairperson Linda Arcularius presiding, Julie Bear, Ervin R. Lent,
Carroll M. Hambleton, Jr., and Michael Dorame.
Supervisor Hambleton provided the Invocation, and Supervisor Bear led the
Pledge of Allegiance.

Public Comment
|
The Chairperson announced the public comment
period. Ms. Virginia
Reynolds, Chairperson of the Inyo County Mental Health Board addressed the
Board to talk about the County’s Mental Health Program. She read a letter into the record, which identified some of
the Board’s concerns. Supervisors
Hambleton and Arcularius praised Ms. Reynolds and the other members of the
Mental Health Board for their continuing dedication to the Mental Health
Program in Inyo County and thanked Ms. Reynolds for her leadership of the
Board. Ms. Jan Almquist, in
commemorating the one-year anniversary of the events of September 11,
2001, shared excerpts of President Bush’s speech after last year’s
9-11 attacks entitled “Freedom Enjoyed.”
Supervisor Lent expressed his concern with a letter, which was,
dated 8-30-02, sent by the Chairperson, Supervisor Arcularius, opposing
SB1828 and SB483, which would have a detrimental effect on Inyo County
mining operations. Supervisor
Lent indicated that he was not involved in the process and the letter was
not submitted for full Board approval.
Supervisor Arcularius and the County Administrator explained that
the letter was formulated based on the County’s previously approved
legislative platform and as such the issuance of the letter was within the
scope of the Chairperson’s authority.
The County Administrator went on to explain that when next year’s
County Legislative Platform is presented for Board consideration he will
include a discussion on the complete process.
The Chairperson, in commemoration of September 11, 2001, reflected
on the events of that day, shared some of her own personal feelings with
regard to the attacks and paid, on behalf of the County,
her heartfelt remembrances and condolences to those effected by the
events of 9-11-01.

Planning
Dept./ Keating App. For Water Rights
|
Supervisor Arcularius, declared a conflict on the
item regarding the Keating Appropriative Water Rights Application, because
of her family’s ownership of water rights at Pine Creek, asked the Vice
Chairperson, Supervisor Dorame to preside as Chairperson for the item and
left the Board Room. Ms.
Andrea Clark, Resource Management Coordinator, reviewed the letter and
responded to questions from the Board.
The Board and Staff discussed various aspects of the project and
the effects on the surrounding land, resources and community.
Ms. Jan Almquist addressed the Board asking the Board to support
the letter opposing the project.
Moved by Supervisor Bear and seconded by Supervisor Hambleton to approve
the letter protesting Appropriative Water Rights Application 31265
submitted to the State Water Resources Control Board, Division of Water
Rights, by Mr. Joseph M. Keating; and authorize the Planning Director to
sign on behalf of the County. Motion
carried unanimously.

Reconvene
|
The presiding Chairperson recessed the meeting at
10:10 a.m., reconvening at 10:20 a.m., with all Board Members present,
including Supervisor Arcularius who resumed her duties as Chairperson.
She acknowledged Ms. Marylou Priest, Field Representative for
Assemblyman Phil Wyman, thanking her for visiting the Board’s Meeting on
behalf of the Assemblyman.

Landfill Generator and Independence Transmission Lines
|
The County Administrator responded to questions
from the Board regarding the Staff recommendations for providing power to
the Lone Pine and Independence Landfills.
Moved by Supervisor Dorame and seconded by Supervisor Hambleton to
a)
authorize the purchase of an Onan 17-kilowatt, 120/240 volt LPG-powered
generator for use at the Lone Pine Landfill, from Cummins West, Inc., of
Bakersfield, in an amount not to exceed $8,436.83 and b) authorize a
purchase order to the City of Los Angeles Department of Water and Power
for the construction of electrical power transmission lines to the
Independence Landfill in an amount not to exceed $9,924.60.
Motion carried unanimously.

Treasurer/Appt. Oversight Comm.
|
Moved by Supervisor Dorame and seconded by
Supervisor Hambleton to accept the resignation of Mr. Paul Greggersen from
the Treasury Oversight Committee and confirm the appointment of the County
Treasurer’s nominee for the position, Mr. Joe Andrews to the Committee.
Motion carried unanimously.

Asphalt Materials Contract
|
Moved by Supervisor Dorame and seconded by
Supervisor Hambleton to award and approve the contract for the provision
of plant mixed asphalt surfacing materials to Intermountain Slurry, dba
Desert Aggregate of Bishop, in an amount not to exceed $158,380; and
authorize the Chairperson to sign. Motion carried unanimously.

Supervisor Hambleton to approve the minutes of August 13, 2002, Board of
Supervisors Meeting. Motion carried unanimously on a three-to-zero
vote, with Supervisors Lent, Hambleton and Dorame voting yes, and with
Supervisors Arcularius and Bear abstaining.

approve the minutes of the August 27, 2002, Board of Supervisors Meeting.
Motion carried unanimously on a four-to-zero vote, with Supervisors

Dorame abstaining.

H&H-Behavioral
Hlth./Merced Manor Contract
|
Moved by Supervisor Dorame and seconded by Supervisor Bear to ratify
the Contract between the County of Inyo and Merced Manor for residential
placement for adults in a locked facility, for the period of July 16,
2002, through June 30, 2003, in an amount not to exceed $50,000 contingent
upon the Board’s adoption of a FY 2002-03 budget; and authorize the
Chairperson to sign. Motion
carried unanimously.

Board Members
and Staff Reports
|
The Board Members reported on their activities during the preceding
week, including a request by Supervisor Dorame to have a discussion on HR
7893 grant funding for Mosquito Abatement agendized, and a request to have
a letter regarding RSIP Funding placed on next week’s agenda, a thank
you to the Bishop Airport Advisory Committee from Supervisor Bear and a
report on the RCRC Meeting by
Supervisor Arcularius. The
County Administrator notified the Board that (a) the Final Budget Adoption
has been rescheduled to begin at 8:00 a.m., on Tuesday, September 24,
2002, in the Board of Supervisors Room, at the County Administrative
Center, in Independence; (b) the Standing Committee Meeting scheduled for
September 26 has been rescheduled for sometime during the week of October
21-25, 2002.

There was no closed session agendized or considered at this meeting
and there was no report on closed session given.

Adjournment
|
The Chairperson adjourned the regular meeting at 11:30 a.m., to 9:00
a.m., Tuesday, September 17, 2002, in the Board of Supervisors Room, at
the County Administrative Center, in Independence.
