Org./Wild Iris Domestic Violence Awareness Month

A representative of Wild Iris addressed the Board to provide additional information on Domestic Violence Awareness Month and presented the Board with purple ribbon pins, which should be worn to show support to end domestic violence.  Moved by Supervisor Hambleton and seconded by Supervisor Lent to proclaim October 2002, as Domestic Violence Awareness Month.  Motion carried unanimously, with Supervisor Bear absent.

Resol. #2002-55/Grant for SUV Brochure

On a motion by Supervisor Dorame and a second by Supervisor Hambleton, Resolution No. 2002-55, entitled “A Resolution of the Board of Supervisors of the County of Inyo, State of California, Approving the Application for Grant Funds from the Recreational Trails Program for Motorized Projects” for the updating, printing and distributing of the sport utility vehicle access guide, Motor Touring in the Eastern Sierra Including Death Valley, was adopted: motion unanimously passed and adopted, with Supervisor Bear absent.

Resol. #2002-56/Grant for Amargosa Canyon Trail

On a motion by Supervisor Dorame and a second by Supervisor Hambleton, Resolution No. 2002-56, entitled “A Resolution of the Board of Supervisors of the County of Inyo, State of California, Approving the Application for Grant Funds from the Recreational Trails Program for Non-Motorized Projects” establishing through signs and trail maintenance, the Amargosa Canyon Trail, was adopted:  motion unanimously passed and adopted, with Supervisor Bear absent.

Integ. Waste/ ESJPA Monitoring Wells

The request by Integrated Waste for approval of Amendment No. 1 to the Agreement between the County of Inyo and Environmental Services Joint Powers Authority (ESJPA) adding two additional groundwater monitoring wells at the Keeler waste disposal site, increasing the Contract amount by $14,175 to a total not to exceed $179,576, was pulled from consideration by the County Administrator.

Transit Program/ Computer, Peripherals and Printers P.O.

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve A) the purchase of the following through the CMAS Agreement: (a) three personal computers and peripherals from Gateway, in an amount not to exceed $5,394, plus tax and shipping; (b) one Toshiba laptop and peripherals from CDWG, in an amount not to exceed $1,617.22, plus tax and shipping; and (c) one Hewlett Packard laserjet printer and peripherals from CDWG in an amount not to exceed $2,158.71, plus tax and shipping; and B) the purchase software for Microsoft products from sole-source provider Insight Direct in an amount not to exceed $1,241.96.  Motion carried unanimously, with Supervisor Bear absent.

Resol. #2002-57/Taxation of a Portion of the Tri-County Fairgrounds

On a motion by Supervisor Lent and a second by Supervisor Hambleton, Resolution No. 2002-57, entitled “A Resolution of the Board of Supervisors of the County of Inyo, State of California, Adopted Pursuant to Revenue and Taxation Code Section 155.20, Exempting from Property Taxation Certain Possessory Interests in the Tri-County Fairgrounds,” was adopted:  motion unanimously passed and adopted, with Supervisor Bear absent.

Assessor/ Ordinance Changing Assessment Date

Moved by Supervisor Lent and seconded by Supervisor Hambleton to waive the first reading of an ordinance entitled “An Ordinance of the Board of Supervisors of the County of Inyo, State of California, Amending Section 4 of Ordinance 430 and Section 3.28.050A of the Inyo County Code to Designate January 1, Rather Than March 1, as the Date Used to Determine Whether the Reassessed Value of Property Damaged or Destroyed by Misfortune is Utilized for Tax Liability Purposes in the First Fiscal Year Subsequent to the Damage or Destruction;” and schedule October 8, 2002 in the Board of Supervisors Room, at the County Administrative Center in Independence, as the date and place for the enactment.  Motion carried unanimously, with Supervisor Bear absent.

Assessor/ Bertholf Contract Amendment

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve Amendment No. 1 to the Contract between the County of Inyo and Harold W. Bertholf, Inc. to comply with Section 674(d) of the Revenue and Taxation Code; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

Auditor/So. Inyo Fire Dist. Fee Collection Contract

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve the Agreement between the County of Inyo and Southern Inyo Fire Protection District for the collection of special taxes, fees and assessments; and authorize the Chairperson to sign, contingent upon the appropriate signatures being obtained.  Motion carried unanimously, with Supervisor Bear absent.

County Counsel/ Local Agencies Conflict Code

Moved by Supervisor Lent and seconded by Supervisor Hambleton to receive and approve the 2002 Conflict of Interest Code Biennial Reports from Local Agencies as requested by Staff and approve the Bishop Joint Union High School Conflict of Interest Code.  Motion carried unanimously, with Supervisor Bear absent.

County Counsel/ County Dept. Conflict Codes

Moved by Supervisor Lent and seconded by Supervisor Hambleton to receive and approve the 2002 Conflict of Interest Code Biennial Reports from County Departments as recommended by Staff and approve the Conflict of Interest Codes received from the Coroner and the District Attorney.  Motion carried unanimously, with Supervisor Bear absent.

H&H-HIV/MOU and Contract Amendments

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve Amendment No. 2 to the Contract between the County of Inyo and the California Department of Health Services for HIV/AIDS Education and Prevention programs, increasing the amount by $1,200 to a total of $209,700, and adding an MOU for the evaluation of local interventions; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

H&H-Hlth Serv./ Health Officer Contract

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve the Contract between the County of Inyo and James Richardson, M.D., for Health Officer services for the period of October 1, 2002, through June 30, 2003, in an amount not to exceed $73,189, and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

H&H-IHSS/ Consulting Contract Amendment

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve Amendment No. 1 to the Contract between the County of Inyo and Newlin and Newlin Consulting for In-Home Supportive Services Consulting, increasing the Contract by $675 to an amount not to exceed $6,675; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

The request by the Health and Human Services Department, for the Board to adopt a resolution authorizing the Health and Human Services to apply for and receive grant funds for mentor services for federal fiscal year 2002-2003, was pulled from consideration by the Department.

H&H-Tobacco Pgrm./Prgm. Evaluation  Contract

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve the Contract between the County of Inyo and James E. Fletcher Ph.D., for mandated Tobacco Program evaluation, for the period of September 1, 2002, through June 30, 2003, in an amount not to exceed $5,000; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

H&H-WIC Pgrm./Program Contract Amendment

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve Amendment No. A05 to the Contract between the County of Inyo and the California Department of Health Services, Women, Infants and Children Program, increasing the grant funds by $27,238 to a total amount of $589,906 for the period of October 1, 1999, through September 30, 2002; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

P.W./CDF Access Contract for County Work

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve the Agreement between the County of Inyo and the California Department of Forestry (CDF) for the installation of water and sewer lines across County Owned Property in the community of Independence, which are necessary for the construction of the proposed CDF Fire Station in Independence.  Motion carried unanimously, with Supervisor Bear absent.

Resol. #2002-58/Tract Map #235A

On a motion by Supervisor Lent and a second by Supervisor Hambleton, Resolution No. 2002-58 was adopted, releasing certain property from the obligations of a document recorded in Vol. 254 Page 41 of Official Records, entitled “Covenant of Agreement to Hold Property as One Parcel,” recorded July 15, 1981; and approve Tract Map #235A and accept Offer of Dedication as recommended by Staff: motion unanimously passed and adopted, with Supervisor Bear absent.

P.W.-LTC/Road Audit Contract

Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve the Contract between the County of Inyo and Bartig, Basler & Ray for the provision of auditing services for Fiscal Year 2001/2002, for the period of August 1, 2002, through June 30, 2003, in an amount not to exceed $8,400; and authorize the Chairperson to sign.   Motion carried unanimously, with Supervisor Bear absent.

Moved by Supervisor Lent and seconded by Supervisor Hambleton to award and approve the Contract for concrete products for FY 2002/03 with Intermountain Slurry, dba Desert Aggregates, in an amount not to exceed $32,990.39; and authorize the Chairperson to sign, contingent upon the appropriate signatures being obtained.  Motion carried unanimously, with Supervisor Bear absent.

Moved by Supervisor Lent and seconded by Supervisor Hambleton to award the bid for and approve the purchase of an OTC 55 Ton Heavy-Duty Shop Press from Steve’s Auto Parts in an amount not to exceed $5,280, including tax and freight.  Motion carried unanimously, with Supervisor Bear absent.

Resol. #2002-59/Rolling Green/Knight Manor Road

On a motion by Supervisor Lent and a second by Supervisor Hambleton, Resolution No. 2002-59 was adopted, approving Program Supplement No. M005 to the Administering Agency-State Agreement for Federal-Aid Projects No. 09-5948 for engineering work for the Rolling Green/Knight Manor Subdivisions Road Rehabilitation Project; and authorize the Chairperson to sign the Program Supplement: motion unanimously passed and adopted with Supervisor Bear absent.

Resol. #2002-60/Olancha CSD Interim Loan

On a motion by Supervisor Lent and a second by Supervisor Hambleton, Resolution No. 2002-60 was adopted, authorizing an interim loan from the County Treasury to the Olancha Community Service District in the amount of $86,800 for FY 2002/03: motion unanimously passed and adopted, with Supervisor Bear absent.

Senior Prgm./ Part-Time Vacancies

Mr. Charles Broten, Inyo-Mono Senior Program Director, provided additional information and further justification for the vacant budgeted positions to be filled.  Moved by Supervisor Hambleton and seconded by Supervisor Lent to approve the recruitment and filling of the following vacant budgeted positions in the Inyo Mono Senior Program, one B-Par (16-29.99 hours/week) Cook I position, one A-Par (1-15.99 hours/week) Cook’s Assistant position, two A-Par Driver I positions and one A-Par Personal Care Aide position.  Motion carried unanimously, with Supervisor Bear absent.

Transit Pgrm/ Driver Vacancy

The County Administrator provided additional justification for the request to fill a vacant driver position in the Transit Program.  Moved by Supervisor Lent and seconded by Supervisor Hambleton to approve the recruitment and filling of a vacant full-time Transit Driver position for Mammoth, in the Inyo Mono Transit Program.  Motion carried unanimously, with Supervisor Bear absent.

Water Dept./Salt Cedar Seasonal Positions

Mr. Doug Daniels, Inyo County Water Department, provided additional information on the request to hire seven seasonal employees for the Salt Cedar Program.  Moved by Supervisor Dorame and seconded by Supervisor Hambleton to approve the recruitment and filling of seven seasonal positions in the Water Department for the Salt Cedar Program.  Motion carried unanimously, with Supervisor Bear absent.

Ordinance 1056/ VSO Require-ments

On a motion by Supervisor Dorame and a second by Supervisor Hambleton, Ordinance 1056, entitled “An Ordinance of the Board of Supervisors, County of Inyo, State of California, Amending Section 2.30.050(d) of the Inyo County Code to Delete the Requirement for the County Veterans Service Officer to Obtain and Maintain Federal Certification,” was adopted: motion unanimously passed and adopted, with Supervisor Bear absent.

Parks/Ordinance for Fees for Parties Over 14

Mr. Chuck Hamilton, Deputy County Administrator, reviewed the Staff report and recommendations regarding an ordinance establishing fees for use of the Tecopa Hot Springs Park by groups larger than 14 people.  The Board and Staff discussed the need to address a variety of issues relative to the Tecopa Hot Springs Park, with this fee ordinance being the first step.  Mr. Hamilton provided additional information regarding the “fee pipes” explaining that the fee station will also have the ability to accept donations.  The Chairperson opened the public hearing at 10:40 a.m., to consider an ordinance entitled “An Ordinance of the Board of Supervisors, County of Inyo, State of California, Establishing Fees for the Use of the Tecopa Hot Springs Park by Groups Larger than Fourteen Persons.” There being no one from the public wishing to address this ordinance, the Chairperson closed the public hearing at 10:41 a.m.

Planning Dept./ Surprise Canyon EIS Comments Vehicle Routes

Moved by Supervisor Dorame and seconded by Supervisor Lent to approve the letter which comments on the scope of the Environmental Impact Statement regarding vehicle route designation in the Surprise Canyon Area located in the Panamint Mountains of Inyo County; and authorize the Chairperson to sign.  Motion carried unanimously, with Supervisor Bear absent.

Rd. Dept./ Change in Authorized Strength

The Board and Staff discussed the request by the Road Department to delete an Equipment Operator series and add a combined Heavy Equipment Mechanic/Operator position.  The Board and Staff discussed the ramifications to combining a position and how the Countywide Salary Survey will effect this action.  Moved by Supervisor Dorame and seconded by Supervisor Lent, to  A) approve a change in authorized strength by deleting one Equipment Operator I/II, Range 58/60 ($2,377-$2,892/$2,494-$3,028), plus 2-1/2% tool allowance; and adding one Road Heavy Equipment Mechanic/Equipment Operator I position, Range 58 ($2,377 - $2,892); and B) authorize the recruitment and filling of the Road Heavy Equipment Mechanic/Equipment Operator I position at Range 58.  Motion carried unanimously, with Supervisor Bear absent.

BofS/Minute Approval

Moved by Supervisor Dorame and seconded by Supervisor Hambleton to approve the minutes of the September 10, 2002, Board of Supervisors Meeting.  Motion carried unanimously, with Supervisor Bear absent.

Rd. Dept./9-Mile & Homewood Canyon Projects

The Public Works Director, Mr. Jeff Jewett, addressed the request from Western Stabilization to  stop the 9 Mile Canyon and Homewood Canyon Road Projects in order to address the issue of a subcontractor on those projects not meeting County specifications.  Mr. Jewett explained that Homewood Canyon Project has been completed and 9 Mile Canyon is do to start in the very near future.  He suggested the Board direct him to conduct an investigation into the allegations and report back to the Board on his findings next week.  The Board concurred with Mr. Jewett’s suggestion, asked that he also work with Western Stabilization with regard to the investigation, and give Western Stabilization the opportunity to be present during the future discussions.

The Board Members briefly reported on their activities during the preceding week, including the Joint Collaborative Planning Meeting, and with Supervisor Arcularius notifying the Board that the Governor has vetoed the legislation which the County had opposed because of the impacts to CR Briggs’ operations in Inyo County.
