The Board of
Supervisors of the County of Inyo, State of California, met in regular session
at the hour of 8:12 a.m., on Tuesday,
November 12, 2002, in the Board of Supervisors Room, County
Administrative Center, Independence, with the following Supervisors present:
Chairperson Linda Arcularius presiding, Carroll M. Hambleton, Jr., and
Michael Dorame. Supervisors Julie Bear and Ervin Lent were absent. Supervisor Hambleton provided the Invocation, and Supervisor
Dorame led the Pledge of Allegiance.

The Chairperson announced the public comment period and read into the
record a statement honoring Veterans.

The
Chairperson recessed open session at 8:15 a.m., to convene in closed

of Laws Ranch Dispute between LADWP and County of Inyo, Adjudication of
Dispute Pursuant to the Long Term Water Agreement entered June 1997 as
Stipulation and Order of Judgment, Inyo County Superior Court, Case 12908.
County Counsel announced that Agenda Item No. 4.
CONFERENCE
WITH LEGAL COUNSEL EXISTING LITIGATION (Pursuant to Government Code
Section 54956.9(a)- Lane v. County of Inyo, WCAB No. 029055,
was pulled from
consideration and would not be discussed in closed session.

& Families Comm.
|
The request for the
Board to waive the County’s Fixed Asset Policy for the Inyo County
Children and Families Commission and adopt a different Fixed Asset Policy
as presented for the Commission only, was pulled from consideration at the
request of the department.

Coroner/Salary Adjustment
|
Moved by Supervisor Hambleton and seconded by
Supervisor Dorame to waive the first reading of an ordinance entitled
“An Ordinance of the Board of Supervisors, County of Inyo, State of
California, Amending Section 2.88.040 of the Inyo Code to Increase the
Salary for the Coroner” and schedule November 12, 2002, in the Board of
Supervisors Room, at the County Administrative Center, in Independence as
the date and place for the enactment.
Motion carried unanimously, with Supervisors Bear
and Lent absent.

Resol. #2002-69/ Old Jail
Asbestos Abatement Project
|
On a motion by Supervisor Hambleton and a
second by Supervisor Dorame, Resolution No. 2002-69 was approved, accepting the
improvements and authorizing the recording of a Notice of Completion for
the Old Inyo County Jail Asbestos Abatement Project: motion unanimously
passed and adopted with Supervisors Bear and Lent absent.

Resol. #2002-70/ Ft. Indy
Road Project
|
On a motion by
Supervisor Hambleton and a second by Supervisor Dorame, Resolution No.
2002-70 was approved, accepting the improvements and authorizing
the recording of a Notice of Completion for the Fort Independence Road
Resurfacing Project: motion unanimously passed and adopted, with
Supervisors Bear and Lent absent.

P.W.-Bishop A/P/
Pestermaster Services
|
Moved by Supervisor
Hambleton and seconded by Supervisor Dorame to ratify the emergency
purchase order to Pestmaster Services, Inc., for the preventative
hantavirus decontamination of the building at the Bishop Airport known as
the old hospital building in an amount not to exceed $10,440.
Motion
carried unanimously, with Supervisors Bear and Lent absent.

Resol. #2002-71/ Guard Rail
Project
|
On a motion by Supervisor Hambleton and a
second by Supervisor Dorame, Resolution No. 2002-71 was adopted, approving Program
Supplement No. M006 to Administering Agency-State Agreement for
Federal-Aid-Projects No. 09-5948; and authorizing the Chairperson to sign
the supplement: motion unanimously passed and adopted, with Supervisors Bear
and Lent absent.

Planning Dept./ Resource
Management Update
|
Ms. Andrea Clark,
Resource Management Coordinator, presented Staff’s Status report on
pertinent resource management issues.
Moved by Supervisor Dorame and seconded by Supervisor Hambleton to
approve the workplan as submitted by Staff.
Motion carried unanimously, with Supervisors Bear
and Lent absent.

BofS/Minute Approval
|
Moved by Supervisor
Hambleton and seconded by Supervisor Dorame to approve the minutes of the
Board of Supervisors Meeting of A) September 24, 2002; B) October 1, 2002;
C) October 8, 2002; and D) October 15, 2002.
Motion carried unanimously, with Supervisors
Bear and Lent absent.

Planning/Waive CUP Fees
|
Mr. Chuck Thistlethwaite, Planning Director,
provided the Board with information regarding the amount of the fees,
which would need to be waived for the conditional use permit being
required by the Friends of
the Tecopa Hot Springs. Moved
by Supervisor Dorame and seconded by Supervisor Hambleton to waive the
permit application fees, in an amount not to exceed $410, for a
conditional use permit for a building in which to conduct the Family
Resource Center Program. Motion carried unanimously, with Supervisors
Bear and Lent absent.

Public Comment
|
For
the benefit of those in the audience, the Chairperson reopened public
comment and again read into the record a statement commemorating Veterans
and Veterans Day.

|
The
Chairperson recessed open session at 1:40 p.m., to reconvene in closed
session to continue discussion on previously identified closed session
items.

Report on Closed Session
|
The
Chairperson recessed closed session at 3:40 p.m., to reconvene in open
session to receive a report on closed session.
County Counsel reported there were no items discussed in closed
session, which were required by law to be reported on in open session.

Adjournment
|
The
Chairperson adjourned the regular meeting at 3:40 p.m., to 9:00 a.m.,
November 26, 2002, in the Board of Supervisors Room, at the County
Administrative Center, in Independence.
