The Board of
Supervisors of the County of Inyo, State of California, met in regular session
at the hour of 9:20 a.m., on, in the Board of Supervisors Room, County
Administrative Center, Independence, with the following Supervisors present:
Chairperson Michael Dorame presiding, Linda Arcularius, Julie Bear, Ted
Williams, and Carroll M. Hambleton, Jr.
Supervisor Hambleton provided the Invocation, and Supervisor Williams led
the Pledge of Allegiance.

Public Comment
|
The
Chairperson announced the public comment period.
Supervisor Dorame talked about his family’s personal fight with
breast cancer, reminding everyone that October it Breast Cancer Awareness
Month. He encouraged everyone
to support the events, which will be taking place to raise money to help
find a cure for this treacherous disease.

County Dept. Reports
|
Ms. Leslie
Klusmire, Planning Director, provided the Board with a survey regarding
the Collaborative Planning efforts.
|
|
Resol. #2003-59/ Eastern
Sierra College Dedication
|
Supervisor
Arcularius reported on the recent ceremony dedicating the new Eastern
Sierra College Center. On a
motion by Supervisor Arcularius and a second by Supervisor Bear,
Resolution No. 2003-59 was adopted, commemorating the dedication of the Eastern Sierra College Center.
Motion carried unanimously.

Org.-Wild Iris/ Domestic
Violence Awareness
|
The Domestic Violence Coordinator for Wild
Iris, provided additional information and statistics regarding the effects
of domestic violence and presented the Board with “ribbon” pins, which
are to be worn to promote domestic violence awareness.
Moved by Supervisor Williams and seconded by Supervisor Bear to
proclaim the month of October 2003, as Domestic Violence Awareness Month
in Inyo County. Motion
carried unanimously.

CAO/Special Mtg.
|
Supervisor Bear requested a discussion of the
Board regarding the possibility of scheduling a special meeting for
tomorrow afternoon in Bishop to accommodate a closed session item
regarding employee negotiations. Supervisor
Williams explained that he wanted to have the opportunity to discuss
upcoming mediation efforts regarding the negotiations prior to the
mediation session scheduled for Thursday, October 9, 2003.
The Board indicated their willingness to call the special meeting
and took a five-minute recess in order for Staff to confirm the
availability of the Conference Room, at the Administrative Services Office
at 785 N. Main Street, in Bishop. The
Chairperson reconvened open
session, with all Board Members present.
Moved by Supervisor Williams and seconded by Supervisor Bear to
schedule a Special Meeting and direct the Assistant Clerk of the Board to
publish an agenda for a Special Meeting of the Board of Supervisors for
3:30 p.m., Wednesday, October 8, 2003, in the Conference Room, at the
Administrative Services Offices at 785 N. Main Street, in Bishop, to
discuss labor negotiations with ICEA and the upcoming mediation.
Motion carried unanimously. At
9:55 a.m., at the conclusion of this motion, the Chairperson recessed the
regular meeting, reconvening at 10:12 a.m., with all Board Members
present.

CAO-Purchasing/ Laptop P.O.
|
Moved by Supervisor Bear and seconded by
Supervisor Williams to award Bid No. 2003-04 for and approve the purchase
of two laptop computers from Gov Connection in an amount not to exceed
$3,858 plus tax. Motion
carried unanimously.

CAO-Purchasing/ Change in Laptop P.O.
|
Moved by Supervisor Bear and seconded by
Supervisor Williams to a) rescind the Board Order of August 19, 2003,
approving the purchase of laptop computers through a State purchasing
contract; and b) ratify the purchase of two laptop computers for Public
Health Preparedness from the low bidder GHA Technologies.
Motion carried unanimously.

Parks/Glacier View Camp-ground Lease
|
Moved by Supervisor Bear and seconded by
Supervisor Williams to approve the Lease Agreement between the County of
Inyo and the City of Los Angeles Department of Water and Power for the
Glacier View Campground property, for the period of April 1, 2003, through
March 31, 2008, at the annual rate of $480 for the period of April 1,
2003, through March 31, 2004 and $500 annually for the remainder of the
term; and authorize the Chairperson to sign.
Motion carried unanimously.

Parks/Diaz Lake Campground Lease
|
Moved by Supervisor Bear and seconded by
Supervisor Williams to approve the Lease Agreement between the County of
Inyo and the City of Los Angeles Department of Water and Power for the
Diaz Lake Campground, for the period of July 1, 2003 through June 30,
2008, at the annual rate of $500; and authorize the Chairperson to sign.
Motion carried unanimously.

H&H-First 5 Comm./Peterson Appointment
|
Moved by Supervisor Bear and seconded by
Supervisor Williams to appoint Ms. Margaret Peterson as the Health and
Human Services Director’s designee to the Inyo County Children and
Families Commission (First 5 Inyo County).
Motion carried unanimously.

H&H-First 5 Comm./Retention Incentives and Office of Ed Contracts
|
Moved by Supervisor Bear and seconded by
Supervisor Williams to approve A) the Agreement between the County of Inyo
and the California Children and Families Commission for the Retention
Incentives for Early Care and Education Providers Matching Funds Awards
Program; and B) the Contract between the County of Inyo and the Inyo
County Superintendent of Schools Office to manage the awards program
locally; and C) authorize the Chairperson to sign the agreements. Motion carried unanimously.

Resol. #2003-60/ Notice of Compl. D.V. Rd. Project
|
On
a motion by Supervisor Bear and a second by Supervisor Williams,
Resolution No. 2003-60 was adopted, accepting the improvements and
authorizing the recording of the Notice of Completion for the Death Valley
Road Resurfacing Project: motion unanimously passed and adopted.

Rd. Dept./Yellow Traffic Paint P.O.
|
Moved
by Supervisor Bear and seconded by Supervisor Williams to approve the
purchase of 275 gallons of yellow traffic paint from TMT Pathways, of
Salem Oregon, in an amount not to exceed $2,029.74. Motion carried unanimously.

BofS/Starlite Community - Rd. Closure
|
With regard to the request from the residents
of the community of Starlite Estates for the Board to
order the developers Beach and Clark to remove the closure gates
and restore the environment to its pre-existing condition before the
closure and right-of-way restrictions were illegally placed [dirt road at
the end of the paved portion of Startlite Drive] and direct that Inyo
County become the Primary Legal Intervener in this matter, Supervisor
Arcularius provided a brief history of the events, which have led to this
request. She reported that
the County has received a letter from the Attorney for the developers
requesting that the discussion be postponed until October 21, 2003, when
he could be present. Supervisor
Arcularius said that it was her desire to hear from the people who were in
the audience at today’s meeting and provide the developer’s Attorney
the opportunity to address the Board on the 21st.
Proponents and members of the community who spoke advocating for
the removal of the gates were Dr. Stacy Brown, Mr. Ray VanDeWeerd, Mr.
Stan Conger, and Ms. Ceal Klinger. The
Board, Staff and members of the audience discussed the request, including:
(a) prescriptive right-of-ways, (b) historical uses of the road, (c)
public access, (d) RS2477 rights, (e) safety and evacuation routes, (f)
emergency access, (g) acts of vandalism, as well as personal property
rights and CSD authority. At
the conclusion of the discussion the Board indicated their desire to have
a workshop to learn more about prescriptive easements, and discussing the
need for the County to develop a policy for involvement in prescriptive
easement issues.
Moved by
Supervisor Arcularius and seconded by Supervisor Bear to direct County
Counsel and Staff to schedule a workshop on prescriptive easements and the
development of a policy for the County’s involvement in these types of
issues. Motion carried unanimously.
Moved by
Supervisor Bear and seconded by Supervisor Arcularius to send a letter
inviting Mr. Pemberton, Attorney for Beach and Clark, to address the Board
to present their position on this issue, during the October 21, 2003,
Board of Supervisors Meeting. Motion
carried unanimously.

Ord. 1073/ Zone Reclass 2003-03/ Kirchnavy
|
On a motion by Supervisor Arcularius and a
second by Supervisor Hambleton, Ordinance 1073 entitled
“An Ordinance of the Board of Supervisors of the County of Inyo,
State of California, Approving Zone Reclassification No. 2003-03/Kirchnavy
and Amending Ordinance No. 943, the Inyo County Zoning Ordinance, by
Reclassifying Two 5,000 Square Foot Pieces of Property Located at the
Northwest Corner of East Mountain View Street and North Jackson Street in
the Community of Lone Pine From C-3-7,500-D (Administrative and
Professional Offices - 7,500 Square Feet Minimum - Architectural Design
Control) to R-1-5,800 (One Family Residences - 5,800 Square Feet
Minimum),” was enacted: motion unanimously passed and adopted.

|
The Chairperson recessed the regular meeting at
12:10 p.m., reconvening at 12:15 p.m., with all Board Members present.

P.W./So. Inyo Airport Adv. Comm. Appointments
|
The Assistant Clerk of the Board requested
that the Southern Inyo Airport Advisory Committee appointments be amended
to accommodate the request for reappointment which was received from Mr.
Kirk Peek prior to the deadline and which was inadvertently misplaced.
Moved by Supervisor Hambleton and seconded by Supervisor Arcularius
to appoint the following to the Southern Inyo Airport Advisory Committee
to complete four year terms ending June 1, 2007: Ms. Lynne Bunn, Mr. Joe
Cappello, Mr. Kirk Peek and Mr. Dean Vanderwall and Mr. Robert Gracey to
complete an unexpired term ending June 1, 2004.
Motion carried unanimously.

Rd. Dept./Tyler Douglas Memorial Walk
|
Supervisor Williams expressed his support of the Tyler
Douglas Weaver Memorial Walk. Moved
by Supervisor Williams and seconded by Supervisor Hambleton to support the
Tyler Douglas Weaver Memorial Walk to be held on November 11, 2003, along
Brockman Lane, West Line Street and Barlow Lane in Bishop and direct the
Road Commissioner to issue all necessary permits.
Motion
carried unanimously.

District/Mesa CSD
Appointment
|
Moved by Supervisor Arcularius and seconded
by Supervisor Bear to, per Government Code Section 17809(c)(2), waive the
60-day period and appoint Mr. Fred Brauer, Jr., to the Mesa Community
Service District Board of Directors to complete an unexpired term ending
December 5, 2003. Motion
carried unanimously.

BofS/Minute Approval
|
Supervisor Arcularius requested clarification
on the Board Members and Staff Reports portion of the September 16, 2003,
minutes, asking about the reference to the “Owens Valley Committee
Meeting.” Supervisor
Williams clarified that the meeting being reported on was the Interagency
Committee on Owens Valley Land and Wildlife.
Supervisor Williams asked that the record be corrected to reflect
the correct committee. Moved
by Supervisor Hambleton and seconded by Supervisor Williams to approve the
minutes of the September 16, 2003, Board of Supervisors Meeting, as
corrected. Motion carried
unanimously.

Board Members and Staff
Reports
|
The Board Members reported on their
activities during the preceding week including an RCRC Meeting, Great
Basin Meeting, Independence Civic Club Meeting, and the Sierra Business
Council Conference. Mr. Chuck
Hamilton, Deputy County Administrator, reported on a paving project at
Izaak Walton Park.

|
The
Chairperson adjourned the regular meeting at 1:10 p.m., to 9:00 a.m.,
October 14, 2003, in the Board of Supervisors Room, at the County
Administrative Center, in Independence.
