Public Comment
|
The
Chairperson announced the public comment period.
The Assistant Clerk of the Board read into the record a letter
dated November 3, 2003, from Ms. Linda Arnold of Bishop, regarding no pay
phone service in the Courthouse. Supervisor
Dorame responded to Ms. Arnold’s letter explaining that the phone
companies control the placement of pay phones, which is based on revenues
being generated by the phones. Mr.
Richard Cervantes, Lone Pine Resident, addressed the Board to complain
about the lack of phone service in the Charleston View area of the County.
Supervisor Dorame provided a brief history of his and the
County’s efforts to work with the California PUC to resolve this issue.
Supervisor Dorame explained once again that the phone service is
provided by the phone companies, which are governed by the PUC and not the
local jurisdictions.

County Dept. Reports
|
The
Chairperson announced the County Department Report period. The Public Works Director provided the Board with the
report regarding the Town Water Systems and the Department’s
recommendations regarding the rate change.
Mr. Jewett indicated that the information would be available in the
County Library Branches and on the County’s web page, as well as in the
Public Works Department.

Workshop/Rd. Closure
Policies on Federal Lands
|
The Chairperson recessed open session at
9:20 a.m., to convene in a workshop with representatives of the Inyo
National Forest, and the Bishop and Ridgecrest Bureau of Land Management
offices, regarding road closure policies on Federal lands. The Chairperson recessed the workshop at 11:15 a.m., to
convene in open session, with all Board Members present, except Supervisor
Bear.

Resol. #2004-64/ Jobs Housing Incentive Grant
|
On a motion by Supervisor Williams and a
second by Supervisor Arcularius, Resolution No. 2003-64, entitled
“Resolution of the Board of Supervisors, County of Inyo, State of
California, Authorizing the County of Inyo to Participate in a Jobs
Housing Balance Incentive Grant Program,” was adopted:
and approval was granted for the Jobs Housing Balance Incentive
Grant Standard Agreement authorizing the acceptance of a $1,000 grant; and
authorizing the Chairperson to sign:

Auditor/Maximus Contract Property Tax Admin. Serv.
|
Moved by Supervisor Williams and seconded by
Supervisor Arcularius to approve the Contract between the County of Inyo
and Maximus, Inc., for preparation of the FY 2003-2004 Property Tax
Administration Services in an amount not to exceed $2,500; and authorize
the Chairperson to sign, contingent upon the appropriate signatures being
obtained. Motion carried unanimously, with Supervisor Bear
absent.

Auditor/Maximus Contract for State Mandated Costs Claim
|
Moved by Supervisor Williams and seconded by Supervisor Arcularius to
approve the Contract between the County of Inyo and Maximus, Inc., for
preparation of the FY 2003-2004 SB90 State Mandated Costs Claim in an
amount not to exceed $16,800; and authorize the Chairperson to sign,
contingent upon the appropriate signatures being obtained.
Motion carried unanimously, with Supervisor Bear absent.

Auditor/PRM Contract County Cost Plan
|
Moved by Supervisor Williams and seconded by
Supervisor Arcularius to approve the Contract between the County of Inyo
and Public Resource Management Group (PRM) for preparation of the FY
2003-2004 Countywide Cost Plan for use in FY 2004-2005, in an amount not
to exceed $6,000 and authorize the Chairperson to sign, contingent upon
the appropriate signatures being obtained.

carried unanimously, with Supervisor Bear absent.

H&H-Mental Hlth Advisory Board Appointment
|
Moved by Supervisor Williams and seconded by
Supervisor Arcularius to appoint Ms. Debra Breazele to the Mental Health
Advisory Board to complete an unexpired term ending June 30, 2005. Motion carried unanimously, with Supervisor Bear absent.

H&H-Mental Hlth Advisory Board Appointments

Moved by Supervisor Williams and seconded by
Supervisor Arcularius to appoint Ms. Betty Hinga, Ms. Sharon Partridge and
Ms. Virginia Reynolds to the Mental Health Advisory Board to complete
unexpired terms ending June 30, 2006.

|
Moved by Supervisor Williams and seconded by Supervisor Arcularius to
establish the membership total and quorum for the Children Services
Council; and appoint members for FY 2003-2004 as recommended by Staff.

P.W./B.P. Street- light Relocation Project Contract
|
Moved by Supervisor Williams and seconded by
Supervisor Arcularius to award and approve the contract for the Big Pine
Streetlight Relocation Project to TDS Engineering in an amount not to
exceed $19,490; authorize the Chairperson to sign, contingent upon the
appropriate signatures being obtained; and authorize the Public Works
Director to execute all other contract documents, including contract
change orders, to the extent permitted by Public Contract Code Section
20142, and other applicable law. Motion carried unanimously, with Supervisor Bear
absent.

The
Chairperson recessed open session at 2:15 p.m., to convene in closed

Resol. #2003-65/ Transfer of Duties & Property to County Board of
Education
|
The County
Administrator provided additional information on, further justification
for, and responded to questions regarding the transfer of duties and
property from the County to the County Board of Education.
Moved by Supervisor Hambleton and seconded by Supervisor Arcularius
to approve the overall concept to transfer duties and property in the
Community of Independence from the County of Inyo to the County Board of
Education and (A) find that that the transfer of the land from the County
of Inyo to the County Board of Education, is exempt from the California
Environmental Quality Act (CEQA) under CEQA Guidelines 15312 “ sales (or
transfers) of surplus government property; (B) find that pursuant to
Government Code Section 25365, the property is “not required for County
use;” (C) adopt Resolution No. 2003-65, entitled “A Resolution of the
Board of Supervisors of the County of Inyo, State of California, Modifying
the Transfer of Duties and Function to the Inyo County Board of Education
in Resolution 74-81; Transferring Certain Real Property to the Board of
Education; and Discharging Certain County Obligations to the Board of
Education; and (D) authorize the County Administrator to sign and execute
the Grant Deed to transfer the property.
Motion

Planning/Rd. Abandonment #2003-02/ Watterson
|
The Chairperson opened the public hearing, at
4:10 p.m., on Road Abandonment No. 2003-02/ Watterson to consider a
proposed resolution entitled “A Resolution of the Board of Supervisors
of the County of Inyo, State of California, Declaring its Intent to Vacate
that Portions of Third Avenue and an Unnamed Alley in Darwin Townsite and
Setting and Providing Notice of a Public Hearing on Said Vacations.”
Ms. Adena Fansler, Planning Department, reviewed the Staff report
and recommendations, asking at the conclusion of her presentation that the
staff report and the Planning Commission Report be accepted into the
record. They were marked
Exhibit A and B. The Clerk of
the Board asked that a letter from the applicant supporting the road
abandonment be accepted into the record and it was marked Exhibit C.
There being no one from the public wishing to address this item,
the Chairperson closed the public hearing at 4:30 p.m.

Chairperson opened the public hearing at 4:30 p.m., on Road Abandonment No. 2003-01/Dierdorff and
Mack, to consider a proposed resolution entitled “A Resolution of the
Board of Supervisors of the County of Inyo, State of California, Declaring
its Intent to Vacate That Portions of Third Avenue and an Unnamed Alley in
Darwin Townsite and Setting and Providing Notice of a Public Hearing on
Said Vacations.” Ms. Adena

Supervisor Arcularius and seconded by Supervisor Hambleton to authorize
the submittal of a FY 2003 CERT Program Grant Application in the amount of
$5,425 and adopt Resolution No. 2003-68, authorizing the County
Administrator to approve all grant documents, contingent upon the
appropriate signatures being obtained.

Clerk-Elections/ In Lieu of Election 11-4-03
|
Ms. Beverly Harry, Inyo County Clerk-Recorder, asked that the record
reflect Dan not Don Totheroh as the appointee to the Starlite
Community Board. Moved by
Supervisor Arcularius and seconded by Supervisor Williams to issue an
order declaring appointed in lieu of election those candidates submitted
for the Special Districts for the November 4, 2003 UDEL election. Motion carried unanimously, with Supervisor Bear absent.

|
Moved by Supervisor Hambleton and seconded by Supervisor Williams to
approve the minutes of the Board of Supervisors Meetings as follows: A)
the Regular Meeting of October 7, 2003; B) the Regular Meeting of October
14, 2003; C) the Regular Meeting of October 21, 2003; and D) the Special
Meeting of October 22, 2003. Motion
carried unanimously, with Supervisor Bear absent.

Audit Findings, was pulled at the request of the Department.

Supervisor Williams reported on the recent
tour of the Furnace Creek Road in the White Mountains conducted by the
Forest Service.

|
County Counsel reported there were no items
discussed in closed session, which were required by law to be reported on
in open session.
