The Board of Supervisors of the
County of Inyo, State of California, met in regular session at the hour of 9:20
a.m., on Tuesday, November 30, 2004,
in the Board of Supervisors Room, County Administrative Center, Independence,
with the following Supervisors present: Chairperson
Carroll “Butch” Hambleton presiding, Linda Arcularius, Julie Bear, and Ted
Williams. Supervisor Michael Dorame
was absent. Supervisor Hambleton
provided the Invocation, and Supervisor Bear led the Pledge of Allegiance.

Comment
|
The
Chairperson announced the public comment period and there was no one from
the public wishing to address the Board.
|
| County
Depart. Reports
|
The
Chairperson announced the County Department Report period. Ms. Leslie Klusmire, Planning Director, updated the Board
on the McLaren Advisory Measure. She
informed the Board that while the County, as a property owner in the area
received a ballot, Staff was recommending that the County not participate.
She also informed the Board that two additional small parcels,
which had been excluded were being provided ballots.
Ms. Jean Dickinson, Director of Health and Human Services, updated
the Board on a Welfare Directors Meeting she had attended.
Mr. George Milovich, Agricultural Commissioner, updated the Board
on the status of the Mosquito Abatement District’s Benefit Assessment,
clarifying that Prop. 218 requires
the County to contract for the Assessment services and the main reason for
the need for the increase is for the Program to keep pace with employee
COLA’s. Mr. Chuck Hamilton, Deputy County Administrator, informed
the Board that a Household Hazardous Waste Event would be taking place at
the Independence Landfill on Saturday, December 4, 2004, from 9 a.m. to 12
p.m. Mr. Hamilton also
updated the Board on an OES tabletop exercise, which tested the
communications capabilities of the participating organizations information
service officers.

Ms.
Jean Dickinson introduced Ms. Riannah Lummis, Account Clerk I, in the
Health and Human Services Department to the Board.

Integ.
Waste/ Jacobson Helgoth Contract
|
Supervisor Arcularius asked for clarification on the 10%
administration fee on the per diem rate and asked that in the future this
amount be negotiated out. Moved by Supervisor Williams and seconded by
Supervisor Arcularius to approve Amendment No. 1 to the Contract between
the County of Inyo and Jacobson Helgoth Consultants for
technical/consultant services revising Attachment C - Schedule of Travel
and Per Diem Payment; and authorize the Chairperson to sign.
Motion carried unanimously, with Supervisor Dorame absent.

Parks/Diaz
Lake Playground Equipment
|
Moved by Supervisor Williams and seconded by Supervisor Arcularius to
A) award the bid to and approve the contract with Contract Connections,
Inc. of Jacksonville Beach, Florida for the construction of playground
equipment at the Diaz Lake Campground in an amount not to exceed
$37,635.24 for the period of November 16, 2004, through June 25, 2005; and
B) adopt the Notice of Exemption and certify the requirements of the
California Environmental Quality Act have been satisfied.
Motion carried unanimously, with Supervisor Dorame absent.

CAO-Purchasing/
RIMS Mapping Software P. O.
|
Moved by Supervisor Williams and seconded by Supervisor Arcularius to
declare Sun Ridge Systems, Inc., the sole source provider of the RIMS
Mapping Software and authorize the purchase, installation and one year
technical support services of the RIMS Mapping Software for the Office of
Disaster Services in an amount not to exceed $7,150, plus tax.
Motion carried unanimously, with
Supervisor Dorame absent.

Serv./ Cancer Detection Agreement
|
Moved by Supervisor Williams and seconded by Supervisor Arcularius to
approve the Cancer Detection Section Provider Enrollment Agreement between
the County of Inyo and the State of California Department of Health
Services and authorize the Chairperson to sign.
Motion carried
unanimously, with Supervisor Dorame absent.

| Auditor/Tobacco
Settlement Litig. Payment
|
The Deputy County Administrator, Mr. Chuck Hamilton, with regard to
the request for a Contingencies appropriation relative to the tobacco
litigation, requested that the amount of $54,000 be increased to
$54,464.02 to more accurately reflect the amount to be paid to the
hospitals. Moved by
Supervisor Bear and seconded by Supervisor Arcularius to amend the FY
2004-05 County Budget as follows: A) increase appropriations in Tobacco
Settlement Trust Budget Unit 500520, Fund Balance (Object
Code #3000) by $54,464.02 and B) reduce appropriations
in Contingencies General Budget Unit 087100, Contingencies (Object
Code #5901) by
$54,464.02. Motion carried unanimously, with Supervisor Dorame absent.

#2004-58 CAO-Ag. Comm./ Milovich Reappointment
|
Moved
by Supervisor Arcularius and seconded by Supervisor Williams to A)
reappoint George L. Milovich to a four-year term as Agricultural
Commissioner/Sealer of Weights and Measures effective November 30, 2004;
B) approve Amendment No. 2 to the Contract between the County of Inyo and
George L. Milovich for the provision of personal services as the County
Agricultural Commissioner/Sealer of Weights and Measures, increasing the
monthly salary from $6,304.00 to $6,700, effective November 30, 2004, and
authorize the Chairperson to sign, contingent upon the appropriate
signatures being obtained. Motion carried unanimously, with Supervisor Dorame absent.
On a motion by Supervisor Arcularius and a second by
Supervisor Williams, Resolution No. 2004-58, entitled “A Resolution of
the Board of Supervisors County of Inyo, State of California, Rescinding
Resolution No. 2004-56 and setting Salary and/or Terms and Conditions of
Employment for Appointed Officials Employed in the Several Offices or
Institutions of the County of Inyo,” was adopted: motion unanimously
passed and adopted, with Supervisor Dorame absent.

Pine Film Museum
|
Moved
by Supervisor Arcularius and seconded by Supervisor Bear to A) approve
Amendment No. One to the Lease Purchase Agreement between the County of
Inyo and the Southern Inyo Community Foundation, governing the
Foundation’s use, purchase, and construction of a Film Museum on
County-owned land in Lone Pine and authorize the Chairperson to sign; and
B) direct Staff to initiate discussions with the City of Los Angeles
Department of Water and Power (LADWP) on securing the use of the LADWP
property south of the museum property for museum and community parking
needs. Motion
carried unanimously,
with Supervisor Dorame absent.

Statement of Votes Cast
|
Ms.
Mary Roper, Assistant Clerk-Recorder, asked the Board to include in their
order regarding the statement of votes cast the name of Rosetta Garza as
being appointed in lieu of election to the Southern Inyo Healthcare
District Board for Zone 1. Moved by Supervisor Arcularius and seconded by Supervisor
Williams to order accepted the Statement of All Votes Cast at the
Presidential General Election held November 2, 2004, as amended to include
the appointment in lieu of election of Rosetta Garza Director - Zone 1 on
the Southern Inyo Health Care District, for a four-year term.
Motion
carried unanimously,
with Supervisor Dorame absent.

by Supervisor Bear and seconded by Supervisor Williams to ratify the
Contract between the County of Inyo and Kimberly Hall, Psy.D. for the
provision of mental health services for the period of July 1, 2004,
through June 30, 2005, in an amount not to exceed $6,500; and authorize
the Chairperson to sign. Motion
carried unanimously,
with Supervisor Dorame absent.

tion
Counseling and Testing MOU
|
Moved
by Supervisor Williams and seconded by Supervisor Arcularius to approve
the Master Agreement and the Memorandums of Understanding between the
County of Inyo and the State of California, Department of Health Services
for HIV Prevention, HIV Counseling and Testing, and HIV/AIDS Surveillance
for the period of July 1, 2004, through June 30, 2007, in the amount of
$217,800 ($72,600 per fiscal year); and authorize the Chairperson to sign.

#2004-59/ Ground Water Flow Model Grant
|
On
a motion by Supervisor Bear and a second by Supervisor Williams,
Resolution No. 2004-59 was adopted supporting and authorizing the
submittal of a grant entitled “Development of a Groundwater Flow Model
for the Bishop/Laws Area” seeking $132,616 in funds under the Local
Groundwater Management Assistance Act of 2000, for the project period of
October 2005 through May 2007: motion
unanimously passed and adopted,
with Supervisor Dorame absent.

|
The
Board Members reported on their activities during the preceding week,
including an update on the Forest Service’s Centennial Forum by
Supervisor Arcularius, a Fish and Game Advisory Commission meeting, and a
Child Development Policy Institute meeting.

The
Chairperson recessed open session at 10:55 a.m., to convene in closed
session, with all Board Members present, except Supervisor Dorame, to
discuss Agenda Item No. 16. CONFERENCE

- Instructions to Negotiators re: wages, salaries and benefits - Title -

|
The
Chairperson recessed closed session at 11:40 a.m., to convene in open
session to receive a report on closed session.
Assistant County Counsel, Randy Keller, reported there were no
items discussed in closed session, which were required by law to be
reported on in open session.
