The Board of Supervisors of the County of Inyo, State of California, met in regular session at the hour of 8:30 a.m., on Tuesday, February 8, 2005, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Ted Williams presiding, Linda Arcularius, Susan Cash, Jim Bilyeu, and Richard Cervantes. Supervisor Bilyeu provided the Invocation, and Supervisor Cervantes led the Pledge of Allegiance. |

Closed Session |
The Chairperson recessed open session at 8:31 a.m., to convene in closed session, with all Board Members present to discuss Agenda Item No. 17. PERSONNEL [Pursuant to Government Code § 54957] - Public Employee Appointment - Title: Director Water Department. The Chairperson recessed closed session at 9:05 a.m., to reconvene in open session, with all Board Members present. |
Public Comment |
The Chairperson announced the public comment period. Ms. Loralee Cole, Independence Resident, welcomed the new Board Members and briefly updated the Board on the on-going support for the Independence Sports Complex project. Ms. Joy Melgard, Bishop Resident, also welcomed the new Board Members and updated the Board on the Airport Ad Hoc group as well as continued support for the Bishop Airport. |
County Dept. Report |
The Chairperson announced the County Department Report period and there were no reports forthcoming. |
Planning Road Access Workshop |
The Chairperson recessed open session at 9:15 a.m., to convene in a workshop to discuss the development of policy on the closure of public roads on federal lands located in Inyo County. The Chairperson recessed the workshop at 11:15 a.m., to reconvene in open session, with all Board Members present. |
BofS/Save Round Valley Alliance |
Prior to the Board discussing the Save Round Valley Alliance Agenda Item, Mr. Paul Bruce, County Counsel, provided clarification on the Board hearing information on specific development projects from this group. He explained that should information on specific development project be received at this point, it may cause a question of the Board’s impartiality and, in the future preclude the Board from hearing any matters on the specific projects, which may require a Board of Supervisors decision, i.e., appeals, approvals, etc. Ms. Jennifer Fenton representing the Save Round Valley Alliance addressed to the Board to provide information on the group as well as the direction the group is going concerning development in Inyo County. Ms. Fenton explained that she was only providing an introduction of the group and that specific projects would be addressed at the appropriate time. |
BofS/Additional Committee Assignments |
Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to appoint Supervisor Bilyeu as the alternate on Local Agency Formation Commission (LAFCO) and Supervisor Williams as the alternate on Great Basin Unified Air Pollution Control District Board. Motion carried unanimously. |
CAO-Personnel/ Ralph Andersen Contract |
Prior to the Board’s consideration of approval of a contract with Ralph Andersen and Associates for personnel recruitment services, County Counsel, Mr. Paul Bruce, presented the Board with an amended schedule of fees, highlighting the incremental contract payment schedule. Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to approve the Contract between the County of Inyo and Ralph Andersen and Associates for the provision of executive search services for the Water Director recruitment, with the amended scope of work, in an amount not to exceed $20,750 for the period of February 8, 2005, through December 31, 2005, contingent upon the Board’s adoption of a FY 2005-06 budget; and authorize the Chairperson to sign, contingent upon the appropriate signatures being obtained. Motion carried unanimously. |
CAO-Purchasing/ Cell One Contract |
Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to A) ratify the payments made to Cellular One for extended cellular service from November 24, 2004 through February 8, 2005, after the last contract expired on November 24, 2004; B) declare Cellular One as a sole-source provider of cellular phone service, with the existing monthly service of $20 and optional monthly service plans of $35 and $45, depending on the volume of usage and all other terms as specified; and C) approve a one-year amended service agreement with Cellular One ending February 8, 2006; and authorize the County Administrator to sign contingent upon appropriate signatures being obtained. Motion carried unanimously. |
HHS-Mental Hlth. Serv./State Service Contract |
Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to approve the Contract between the County of Inyo and the State of California for the provision of mental health services, for the period of July 1, 2004, through June 30, 2005; and authorize the Chairperson to sign. Motion carried unanimously. |
HHS-Mental Hlth. Serv./Vista Pacifica Contract |
Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to approve Amendment No. One to the Contract between the County of Inyo and Vista Pacifica Center for residential placement for adults in a locked facility, increasing the contract amount by $43,000 to an amount not to exceed $93,000; and authorize the Chairperson to sign. Motion carried unanimously. |
Rd. Dept./Plasma Cutter P. O. |
Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to award the quote for and approve the purchase of a Miller Plasma Cutter, Spectrum 625 and handheld torch with a forty-foot cable to Bishop Welding Supply in an amount not to exceed $2,146.38, including sales tax. Motion carried unanimously.

Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to declare Dooley Enterprises, Inc., as a sole-source provider of ammunition and authorize the purchase of ammunition from Dooley Enterprises, Inc., in an amount not to exceed $8,061.03. Motion carried unanimously.

Moved by Supervisor Cash and seconded by Supervisor Bilyeu to approve the minutes of the January 11, 2005, Board of Supervisors Meeting. Motion carried unanimously. |
HHS-Misc./Appts. Hospital Task Force |
The Board and Staff reviewed the recommendations for appointment to the Hospital Task Force, with the following names being added for consideration: Bishop Fire Chief, Ray Seguine, Kathleen Nelson of the U. S. Forest Service, and residents Gale Holbrook and Jack Handee. Moved by Supervisor Bilyeu and seconded by Supervisor Cervantes to make the appointments to the Southern Inyo Hospital Task Force as recommended by Staff and including Ray Seguine, Kathleen Nelson, Gale Holbrook and Jack Handee. Motion carried unanimously. |

The Chairperson recessed the regular meeting at 11:55 a.m., to reconvene in a workshop at 1:00 p.m., with all Board Members present. |

The Board conducted a workshop to receive an update on the Bishop/Sunland Landfill Evaluation Monitoring Plan. The Chairperson recessed the workshop at 1:25 p.m., to reconvene in closed session, with all Board Members present. |

Report on Closed Session |
The Chairperson recessed closed session at 4:45 p.m., to reconvene in open session to receive a report on closed session. County Counsel reported that with regard to Agenda Item No. 16. CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION [Pursuant to Government Code § 54956.9(a)] - Sierra Club v. City of Los Angeles, Los Angeles Department of Water and Power, Inyo County Superior Court Case No. CVPT-05-347969, which is an action by the Sierra Club against the City of Los Angeles as well as the County of Inyo alleging multiple violations of the MOU, has authorized and directed County Counsel, in a unanimous vote, with Supervisors Arcularius, Cash, Williams, Bilyeu and Cervantes voting yes, to defend the County in this matter. |
