County of Inyo Board of Supervisors |
The Board of Supervisors of the County of Inyo, State of California, met in regular session at the hour of 9:00 a.m., on Tuesday, June 13, 2006, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Susan Cash presiding, Linda Arcularius, Ted Williams, Jim Bilyeu, and Richard Cervantes. Supervisor Cervantes provided the Invocation, and Supervisor Cash led the Pledge of Allegiance.

Public Comment |
The Chairperson announced the public comment period. Supervisor Bilyeu thanked all the voters in the County who supported the recent TOT Ballot Measure, with Supervisor Cash echoing his sentiments. |
County Dept. Reports |
The Chairperson announced the County Department Report period. Mr. George Milovich, Agricultural Commissioner, and Mr. Ernie Poncet, Mosquito Abatement Program, updated the Board on mosquito abatement efforts throughout the County. Ms. Jean Dickinson, Director of Health and Human Services, updated the Board on proposed legislation, which would split health and human services into two departments at the State level. She explained that this legislation is not small county friendly, and asked the Board to keep this on the front burner when dealing with their State organizations. |
Resol. #2006-34/ 12 th Cycle Oil Recycling Grant |
On a motion by Supervisor Arcularius and a second by Supervisor Cervantes Resolution No. 2006-34 was approved, allowing Inyo County to participate in the 2006-2007 Waste Oil Recycling Grant – Twelfth Cycle, in the amount of $15,000 for continual program maintenance and transportation expense for Inyo County’s Used Oil Recycling Program: motion unanimously passed and adopted.

CAO-Personnel/ T. Davito Contract |
Moved by Supervisor Arcularius and seconded by Supervisor Cervantes to approve the Contract between the County of Inyo and Ms. Taya Davito for consulting services pertaining to the preparation of the FY 2006-07 County Budget in an amount not to exceed $20,000 for the period of June 15, 2006, through September 30, 2006; and authorize the Chairperson to sign, contingent upon the appropriate signatures being obtained. Motion carried unanimously.

HHS-Behavioral Hlth./Olive Vista Contract |
Moved by Supervisor Arcularius and seconded by Supervisor Cervantes to approve the Contract between the County of Inyo and Olive Vista Center for the provision of mental health placement services for the period of July 1, 2006 through June 30, 2007, in an amount not to exceed $55,000, contingent upon the Board’s adoption of a FY 2006-07 Budget; and authorize the Chairperson to sign. Motion carried unanimously. Motion carried unanimously.

HHS-Behavioral Hlth./N. Dogris Contract |
Moved by Supervisor Arcularius and seconded by Supervisor Cervantes to approve the Contract between the County of Inyo and Nicholas J. Dogris, Ph.D., for the provision of mental health services in an amount not to exceed $12,000 for the period of July 1, 2006, through June 30, 2007, contingent upon the Board’s adoption of a FY 2006-07 Budget; and authorize the Chairperson to sign. Motion carried unanimously.

HHS-Behavioral Hlth./M. Gonzalez Contract |
Moved by Supervisor Arcularius and seconded by Supervisor Cervantes to approve the Contract between the County of Inyo and Maria Lourdes Gonzalez, LMFT, for the provision of mental health services, in an amount not to exceed $5,000, for the period of July 1, 2006, through June 30, 2007, contingent upon the Board’s adoption of a FY 2006-07 Budget; and authorize the Chairperson to sign. Motion carried unanimously.

HHS-Behavioral Hlth./Sierra Recovery Contract |
Moved by Supervisor Arcularius and seconded by Supervisor Cervantes to approve the Contract between the County of Inyo and Sierra Recovery Center for the provision of residential alcohol and drug treatment in an amount not to exceed $25,000, for the period of July 1, 2006, through June 30, 2007, contingent upon the Board’s adoption of a FY 2006-07 Budget; and authorize the Chairperson to sign. Motion carried unanimously.

Planning Comm./ 1 st District Appt. of Bill Stoll |
Supervisor Arcularius thanked Mr. Stoll for his interest in serving on the Planning Commission representing the First District. Moved by Supervisor Arcularius and seconded by Supervisor Williams to appoint Mr. Bill Stoll as the First District Planning Commissioner to complete an unexpired four-year term ending January 1, 2007 and to complete a four-year term beginning January 1, 2007 and ending January 1, 2011. Motion carried unanimously.

Planning-Yucca Mt./Latir Contract |
Moved by Supervisor Williams and seconded by Supervisor Cervantes to declare Latir Energy Consultants as a sole-source provider of consulting services and approve the Contract between the County of Inyo and Latir Energy Consultants for the period of July 1, 2006 through June 30, 2007, in an amount not to exceed $75,600, contingent upon the Board’s adoption of a FY 2006/07 budget; and authorize the Chairperson to sign. Motion carried unanimously.

Planning-Yucca Mt./Hydrodynamics Contract |
Moved by Supervisor Cervantes and seconded by Supervisor Bilyeu to approve the Contract between the County of Inyo and Hydrodynamics Group, L.L.C., for hydrologic support services for the period of June 1, 2006 through June 30, 2011, in an amount not to exceed $1,040,000, contingent upon (a) the Board’s adoption of future budgets, (b) receipt of the Cooperative Agreement Award Letter, and (c) future funding of the five-year cooperative agreement by the DOE; and authorize the Chairperson to sign contingent upon the appropriate signatures being obtained. Motion carried unanimously.

County Counsel/J. Kirby Contract |
Mr. Paul Bruce, County Counsel, provided additional information and further justification for approval of Mr. John Kirby’s contract for civil litigation services. He explained the responses to the Request for Quotations (RFQs) were independently evaluated by a committee of County officials and that based on the ratings provided by the individuals, Mr. Kirby’s quote rated the highest in experience and the second lowest in price. Mr. Bruce explained that Mr. Kirby’s experience in County matters out-weight the minor difference in the two low bids. In response to a question from Supervisor Arcularius, County Counsel explained that by contracting with an outside attorney for civil litigation services the County could apply all of the attorney’s costs against our $100,000 per case deductible, whereas if the services were provided by an in-house attorney those costs could not be applied to the deductible. Moved by Supervisor Arcularius and seconded by Supervisor Williams to approve the Agreement between the County of Inyo and John D. Kirby, A.P.C., for the provision of civil litigation services, for the initial term from July 1, 2006 through June 30, 2007, with options to extend the Agreement for three additional one year periods, at the rate of $180 per hour with a contract limit of $200,000 for the initial twelve month term; contingent upon the Board’s adoption of a FY 2006-07 Budget; and authorize the Chairperson to sign. Motion carried unanimously.

Board Members and Staff Reports |
The Board Members reported on their activities during the preceding week including a FAC Meeting, a scholarship awards ceremony for the Lone Pine High School, an upcoming Father’s Day Trout Derby in Independence, an update on the fire near Aberdeen, an upcoming BBQ at the Mt. Whitney Fish Hatchery, plans to travel to an upcoming CSAC Board of Directors Meeting, a request to have a TOT Ballot Measure agendized for the June 20, 2006 Board of Supervisors Meeting, a thank you to the volunteers who helped during the recent Primary Election, notification that the scheduling of a Standing Committee Meeting is continuing and while the meeting won’t take place within the 60 day timeframe identified during the Special Joint Meeting with the LADWP Water Commissioners, it will be scheduled as soon as feasible; and a notification that the new air conditioning unit for the Annex Building in Independence was being activated today.

The Chairperson recessed the regular meeting at 9:50 a.m., to reconvene in open session at 10:00 a.m., with all Board Members present.

Ord. 1114/25 mph on Mumy Lane |
On a motion by Supervisor Williams and a second by Supervisor Arcularius, Ordinance 1114 was adopted, establishing 25 miles per hour as the Prima Facie Speed Limit on Mumy Lane: motion unanimously passed and adopted.

Closed Session |
The Chairperson recessed open session at 10:03 a.m., to convene in closed session with all Board Members present to discuss Agenda Items No. 15. CONFERENCE WITH LEGAL COUNSEL ANTICIPATED LITIGATION (Pursuant to Government Code Section 54956.9 (c): Decision whether to initiate litigation (one case) and No. 16. CONFERENCE WITH LABOR NEGOTIATOR[Pursuant to Government Code §54957.6] – Instructions to Negotiators re: wages, salaries and benefits, Employee Organization: ICEA – Negotiators: CAO Ron Juliff and Personnel Analyst Sue Dishion. The Chairperson recessed closed session at 11:00 a.m., to reconvene in open session, with all Board Members present.

Ord. 1115/DUI Program Fees |
On a motion by Supervisor Bilyeu and a second by Supervisor Williams, Ordinance 1115 was adopted repealing Ordinance 1080 and establishing fees for the Driving-Under-the-Influence Program including a $1,021 fee for a new First Offender .20/9-Month Program: motion unanimously passed and adopted.

The Chairperson recessed open session to reconvene in closed session with all Board Members present, to continue discussion on previously noted closed session items.

Report on Closed Session |
The Chairperson recessed closed session at 1:10 p.m., to reconvene in open session, to receive a report on closed session. County Counsel reported there were no items discussed in closed session, which were required by law to be reported on in open session.

The Chairperson adjourned the regular meeting at 1:10 p.m. to 9:00 a.m., June 20, 2006, in the Board of Supervisors Room, at the County Administrative Center, in Independence.
