Special Meeting – Budget Hearings September 11 through September 12, 2006

The Board of Supervisors of the County of Inyo, State of California, met in special session to conduct Budget Hearings at the hour of 9:00 a.m., on Monday, September 11, 2006, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Susan Cash presiding, Linda Arcularius, Ted Williams, Jim Bilyeu and Richard Cervantes. Supervisor Cervantes provided the Invocation, and Supervisor Williams led the Pledge of Allegiance.

Public Comment |
The Chairperson announced the public comment period. Ms. Karen Winnery addressed the Board regarding September 11, 2006 letter concerning the “Reclass, Career Ladder and Equity Adjustment Requests.” She noted that several positions, which are not represented by the union were receiving salary increases and commented that she did not believe there was a difference in how the Personnel Policies and Procedures were applied to positions. She asked that the Board not grant any of the proposed equity adjustments until all of them could be acted upon. |

Budget Message |
The County Administrator presented the FY 2005/2006 Budget Message. He provided the Board with a brief addendum to the budget, requesting that the addendum be included as a part of his recommended budget. Mr. Juliff reviewed the fund balance explaining that the balance, which was around $3.6 million, exceeded expectations because of the good work of the department heads in managing their budgets. He highlighted general fund and non-general fund revenue and expenditure totals, explaining that the Departments had absorbed the COLA’s and increases in the cost of insurance benefits while maintaining core programs and delivery of services. He noted that the budget was balanced with a $500,000 budget for the capital murder litigation, explaining that while it has been reported that the case was settled, there are pending charges against that litigation as well as possible future litigation concerning two recent deaths in the County. Mr. Juliff briefly discussed the use of salary savings and maintaining some level of unanticipated vacancies to balance the budget The Board offered congratulatory remarks to the Budget Team and the Department Heads and employees for their efforts to meet the budget parameters set by the Board and thanked Mr. Juliff and his Budget Team for the preliminary budget workshops which they felt were very helpful to them in understanding the status of the budget. Mr. Juliff went on to discuss the need for the County to provide for long-term budget planning to eliminate the need for the County to rely on fund balance to maintain core services. He briefly discussed the recommended personnel actions, explaining reclassifications, equity adjustments and career ladder moves. He reiterated that the personnel recommendations were for those positions not represented by the union, explaining that those positions represented by the union would be addressed during negotiations. The Board and Mr. Juliff briefly discussed the proposed equity adjustments. The Board also discussed the unfunded liabilities, i.e., retiree health insurance benefits. The Deputy County Administrator, Mr. Kevin Carunchio, reviewed additional items of note in the budget, including the Financial Systems and Network Projects. The Chairperson reviewed the procedure for adoption of this year’s budget, explaining that the Board would tentatively, via nods, approve the individual budgets and at the conclusion of the Budget Hearings the Board would take one final motion to accept the budget as amended throughout the hearings.

Public Admin./ Public Guardian Budget (Pg. 139) |
Ms. Sally Cline, Public Administrator/Public Guardian, addressed the Board. The Board acknowledged Ms. Cline’s impending retirement and offered they thanks for her years of service to the people of Inyo County and well wishes on her retirement. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 Public Administrator/Public Guardian Budget 023600 as recommended by the County Administrator. Motion carried unanimously.

Water Dept. Budgets |
The Board discussed the request for a vehicle, which was identified in this budget, expressing their desire to ensure that vehicles being purchased are fuel-efficient. The County Administrator assured the Board that the Motor Pool requirements for purchasing vehicles took not only cost but fuel efficiency into account. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 Water Dept. Budget 024102; Saltcedar Control Program Budget 024502; DWR Budget 621800; and Sierra Club 1 Budget 621900 as recommended by the County Administrator. Motion carried unanimously.

Treasurer (Pg. 12) |
The Board acknowledged that this was the last budget to be presented by Mr. John Treacy, retiring Treasurer-Tax Collector and offered well wishes on his retirement. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 Treasurer-Tax Collector Budget 010500 as recommended by the County Administrator. Motion carried unanimously.

Sheriff (Pgs. 20 through 46) |
Sheriff Dan Lucas addressed the Board. The Board thanked the Sheriff for his years of service to the people of Inyo County and offered him well wishes in his upcoming retirement. The Board and the Undersheriff John Eropkin discussed the travel line item in the Jail Budget, with the Undersheriff confirming that the high amount is to cover the cost of having cadets in the Academy. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 Sheriff’s General Budget 022700; Sheriff’s Safety Budget 022710; Jail General Budget 022900; Jail Safety Budget 022910; Jail CAD/RMS Budget 022950; Lone Pine Substation Budget 022705; Cal-MMET Task Force Grant Budget 671406; and Animal Services Budget 023900 as recommended by the County Administrator. Motion carried unanimously.

Road (Pgs. 47 through 56) |
The Public Works Director, Mr. Ron Chegwidden, noted that the Road Department budget did not include the funding for the Equipment Operator position. He noted that the savings for this vacancy had been adjusted last year and since the position is expected to be filled this year, the funding needed to be reinstated. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 Road Budget 034600 as amended to include the increase for the Equipment Operator position; State Funded Road Projects Budget 034601; and Congestion Relief Budget 034602 as recommended by the County Administrator. Motion carried unanimously.

The Board and Staff discussed the reclassification and equity adjustment requests funded through the Health and Human Services Budget. Supervisor Cash expressed a concern with the equity adjustment for the Fiscal Manager. Ms. Jean Dickenson, Director of Health and Human Services, offered and the Board concurred, to defer consideration of the Fiscal Manager equity adjustment to a later date, at which time the Board would also consider a subsequent position, which is being developed. The Board noted that their approval of the various HHS budgets would be noted as amended to exclude the Fiscal Manager equity adjustment. The District Attorney, Mr. Art Maillet, addressed the Board to advocate for the equity adjustment for his Administrative Legal Secretary. He explained that she had the same title as that of County Counsel’s position, which is recommended for an increase, as well as like responsibilities to the Administrative Assistant to the Sheriff who is paid at the range being approved for County Counsel’s position. The Board noted that the union represented the District Attorney’s position, whereas the County Counsel’s position is non-represented, and adjustments to union represented positions would need to be made through the negotiation process. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 District Attorney Budget 022400, District Attorney Safety Budget 022410; Drug Suppression Task Force Grant Budget 620306; Victim/Witness Grant 620406; and the Statutory Rape/Vertical Prosecution Grant Budget 620906 as recommended by the County Administrator. County Clerk |
Ms. Beverly Harry, Clerk-Recorder, provided additional information on the Clerk-Recorders budgets. The Board acknowledged Ms. Harry’s impending retirement and offered her well wishes in her future endeavors. The Auditor-Controller, Ms. Leslie Chapman, provided additional information regarding the amount budgeted in the Voting Systems Budget. She explained that the amount reflected in the CAO’s recommendation included revenue already received and confirmed that the Budget reflects and was based on the lesser amount of $158,388, which is the balance due. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 County Clerk/Elections/Recorder Budget 010300; Elections Voting System Budget 621250; and the Recorder’s Micro/System Budget 023401, as recommended by the County Administrator. Supervisor Bilyeu expressed concern with the condition of the restrooms at Mendenhall Park, with Mr. Chuck Hamilton, Deputy County Administrator explaining that they are in the process of being replaced. Supervisor Cervantes echoed his concerns with the condition of the restrooms and other facilities at Diaz Lake. Mr. Hamilton explained that the restrooms are scheduled to be replaced but that due to staffing shortages in the Public Works Department the engineering for the restrooms has been delayed. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 Parks and Recreation Budget 076900 as recommended by the County Administrator. Motion carried unanimously.

County Counsel (Pg. 0275) |
County Counsel, Mr. Paul Bruce, provided additional information and further justification for the equity adjustment for his Administrative Legal Secretary. Supervisor Cash expressed some concern with the disparity of pay between the Administrative Legal Secretary in County Counsel’s Office and the District Attorney’s Office, with the County Administrator reiterating that the union represented the D.A.’s position. County Counsel also thanked the County Administrator and the Board for reinstating the Department’s requested amount for purchasing law books. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to approve the FY 2006-07 County Counsel Budget 010700 as recommended by the County Administrator. Motion carried unanimously.

Advertising County Resources (Pg. 423) |
Representatives of the Bishop Chamber of Commerce, the Film Commission, the Death Valley Chamber of Commerce, the Independence Chamber of Commerce, the Lone Pine Chamber of Commerce and the Big Pine Chamber of Commerce addressed the Board to provide a review of their organization’s activities and to support continued funding of the Chambers. Mr. Doug Thompson of Lone Pine, addressed the Board to recommend the Board continue to provide funding for the Chambers. Mr. Dennis Joncas, Independence Resident, addressed the Board to express his concern with the County continuing to fund those organizations that engaged in efforts to defeat the TOT Ballot Measure in June. Sheriff Dan Lucas addressed the Board to echo Mr. Joncas’ sentiments and to add that he felt that in order to defeat the measure opponents had resorted to rumors and lies about the Sheriff’s Department and his Staff. Ms. Carolyn Joncas, Independence Resident, also addressed the Board to protest continued funding for those organizations, which she believed, used County funding to help defeat the ballot measure in June.

Advertising County Resources Cont’d. |
The Board Members discussed the funding levels for the Chambers of Commerce. They commended the Chambers for the job they do in advertising the County and went on to express concern with the apparent fracturing of the organizations and the need to provide a united advertising front for the entire County. Supervisor Cervantes supported funding the Chambers and recommended that the Board approve the CAO’s recommendation. Supervisor Arcularius expressed her concern with the willingness of several organizations to utilize County funds at the same time they worked actively to defeat the TOT increase, particularly, when the increase would have helped stabilize revenue for the County’s law enforcement and public safety programs. The Board discussed different scenarios of funding for the Chambers as well as the need to develop a new strategy for using County funds to advertise the entire County’s resources through well-defined partnerships and incentives for collaborative projects. The Board Members provided their individual remarks concerning the Advertising County Resources funding. Additionally, the Board and Staff discussed ongoing County projects for which funding was not included in the FY 06-07 budget, including bringing facilities up to ADA requirements; meeting deferred maintenance needs and completing the networking project. Moved by Supervisor Arcularius and seconded by Supervisor Williams to provide 60% of FY 2005-06 funding for the Chambers of Commerce and the Film Commission and provide full funding as recommended by the County Administrator for the Interagency Visitors Center and the Lone Pine Film Festival. Motion carried unanimously. Moved by Supervisor Arcularius and seconded by Supervisor Williams to schedule a workshop on County advertising for October 17, 2006, and invite all Advertising County Resources recipients to participate and direct Staff to include in the Agenda for that workshop an outline of the specific subjects which will be discussed in order to provide those participating the ability to be prepared for the discussions. Motion carried unanimously. Supervisor Cervantes moved, with no second, that Staff provide the attendees of the workshop with a clear list of information, which the Board will expect during this workshop. The motion failed on a one-to-four roll-call vote, with Supervisor Cervantes voting yes, and with Supervisors Arcularius, Cash, Williams and Bilyeu voting no. It was noted by those voting no that the original workshop motion included the direction to provide the attendees with the outline of the workshop so that they could be prepared for the discussions.

Adoption of FY 2006-07 Budget |
The Board and Staff discussed the various changes, which had been made throughout the budget hearings including increasing the Library budget to provide for the purchase of books, to place the interest earned on Economic Stabilization back into the fund and to place the savings from the reductions in the Advertising County Resources grant allocations in Contingencies, to reinstate the funding for the Equipment Operator position in the Road Budget, and adjusting personnel costs in Health and Human Services budget as a result of not increasing the Fiscal Manager salary. Mr. Kevin Carunchio, Deputy County Administrator provided a detailed recap of the budget changes. Moved by Supervisor Bilyeu and seconded by Supervisor Williams to adopt the FY 2006-07 Budget as recommended by the County Administrator and amended during the Budget Hearings, direct Staff to bring back critical additions to the Budget if Fund Balance finishes higher than anticipated, set the adoption of the Final Budget for September 25, 2006 and authorize the County Administrator to sign all the Grants-in-Support and Advertising County Resources funding contracts without deviation with regard to funding amount, contingent upon the appropriate signatures being obtained for the programs and amounts approved by the Board during the Budget Hearings. Motion carried unanimously.
