The Board of Supervisors of the County of Inyo, State of California, met in regular session at the hour of 9:00 a.m., on Tuesday, October 3, 2006, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Susan Cash presiding, Linda Arcularius, Ted Williams, Jim Bilyeu, and Richard Cervantes. Supervisor Cervantes provided the Invocation, and Supervisor Williams led the Pledge of Allegiance.

The Chairperson announced the public comment period and there was no one from the public wishing to address the Board. |
County Dept. Reports |
The Chairperson announced the County Department Report period and there were no reports forthcoming. |
Motor Pool/ Blanket P.O.s |
Moved by Supervisor Williams and seconded by Supervisor Arcularius to authorize blanket purchase orders to vendors and in amounts as recommended by Staff for ongoing repair, parts and tires for the Motor Pool Fleet. Motion carried unanimously.

Integ. Waste/ Blanket P.O.s |
Moved by Supervisor Williams and seconded by Supervisor Arcularius to authorize blanket purchase orders to vendors and in amounts as recommended by Staff for ongoing repair, parts and tires of integrated waste equipment. Motion carried unanimously.

Integ. Waste/ Disposal Fees Payment |
Moved by Supervisor Williams and seconded by Supervisor Arcularius to ratify the payment of $24,260.55 to the State Board of Equalization for Solid Waste Disposal Fees. Motion carried unanimously.

P.W.-So. Inyo Airport Adv. Com/ Appointment |
Moved by Supervisor Williams and seconded by Supervisor Arcularius to appoint Mr. Martin Powell to the Southern Inyo Airport Advisory Committee to fill an unexpired term ending on June 1, 2008. Motion carried unanimously. |
Rd. Dept./DLT Auto Desk Subscription |
Moved by Supervisor Williams and seconded by Supervisor Arcularius to declare DLT Solutions, Inc., a sole-source provider of Auto Desk Subscription services and authorize a purchase order to DLT Solutions, Inc., for Auto Desk Subscription Renewal in an amount not to exceed $3,719.53 including sales tax. Motion carried unanimously.

Rd. Dept./Fabric Construction Signs P.O. |
Moved by Supervisor Williams and seconded by Supervisor Arcularius to approve the purchase of fabric construction signs from Western Highway Products in an amount not to exceed $2,136.14 including sales tax. Motion carried unanimously.

Rd. Dept./Road Signs P.O. |
Moved by Supervisor Williams and seconded by Supervisor Bilyeu to approve the purchase of road signs from Safeway Signs in an amount not to exceed $2,040.51 including sales tax. Motion carried unanimously.

BofS/Disabilities Board Appointments |
Moved by Supervisor Arcularius and seconded by Supervisor Bilyeu to appoint the following to the Developmental Disabilities Area Board #12: Chad Cathey to complete an unexpired three-year term ending December 31, 2006 and Jessica Cathey to complete an unexpired three-year term ending December 31, 2008. Motion carried unanimously. |
Board Members and Staff Reports |
The Board Members reported on their activities during the preceding week, including an upcoming Sierra Nevada Conservancy Meeting, notification of the performances of the United States Air Force Band of the Golden West scheduled for Lone Pine and Bishop, an Arts Council Meeting including an update on the success of the Millpond Music Festival, a Coalition of Chambers meeting, an RCRC Legislative update, Southern Inyo Hospital Open House, an update on new legislation which could affect Yucca Mountain, a reminder of the upcoming Lone Pine Film Festival, constituents and staff meetings and a reminder of the Special Meeting scheduled for Monday, October 9, 2006 at 8:30 a.m.

The Chairperson recessed open session at 9:30 a.m. to convene in closed session, with all Board Members present to discuss Agenda Items No. 12. CONFERENCE WITH LEGAL COUNSEL EXISTING/ANTICIPATED LITIGATION (Pursuant to Government Code Section 54956.9(a) – Harold W. Butterbredt v. Inyo County sheriff’s Department and Correctional Officer Thompson, Inyo County Superior Court Case No. SICVCV04-36910 and No. 13. PERSONNEL (Pursuant to Government Code Section 54957) – Public Employee Performance Evaluation, Title: County Counsel.

Report on Closed Session |
The Chairperson recessed closed session at 10:00 a.m., to receive a report on closed session. County Counsel reported that with regard to Agenda Item No. 12. CONFERENCE WITH LEGAL COUNSEL EXISTING/ANTICIPATED LITIGATION (Pursuant to Government Code Section 54956.9(a) – Harold W. Butterbredt v. Inyo County Sheriff’s Department and Correctional Officer Thompson, Inyo County Superior Court Case No. SICVCV04-36910, the Board, in a unanimous vote, with Supervisors Arcularius, Cash, Williams, Bilyeu and Cervantes voting yes, directed the Office of County Counsel to defend Officer Thompson in this case and authorized the County to indemnify Officer Thompson according to law.

Recess/ Reconvene |
The Chairperson recessed the regular meeting at 10:01 a.m., to convene as the Capital Asset Leasing Corporation. The Chairperson reconvened the regular meeting at 10:25 a.m., with all Board Members present.

Adjournment |
The Chairperson adjourned the regular meeting at 10:25 a.m. to 9:00 a.m., Tuesday, October 10, 2006, in the Board of Supervisors Room, at the County Administrative Center, in Independence.
