Board of Supervisors

The Board of Supervisors of the County of Inyo, State of California, met in regular session at the hour of 9:00 a.m., on Tuesday, September 4, 2007, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Jim Bilyeu presiding, Linda Arcularius, Susan Cash, Beverly Brown, and Richard Cervantes. Supervisor Cervantes provided the Invocation, and Supervisor Cash led the Pledge of Allegiance.

Public Comment

The Chairperson announced the public comment period and there was no one from the public wishing to address the Board.

County Dept. Reports

The Chairperson announced the County Department Report period. Mr. Pat Cecil, Planning Director, updated the Board on the Department’s activities, including WEMO meetings. Mr. Kevin Carunchio, Deputy County Administrator, provided the Board with “Save the Date” flyers for the upcoming Eastern Sierra Regional Partners 2 nd Regional Conference. Mr. Ron Chegwidden, Public Works Director, informed the Board that the installation of “panic buttons” in the Court facilities and in various offices throughout the County has been completed.

HHS-Hlth. Serv./LGA Coordinator Designation

Moved by Supervisor Cash and seconded by Supervisor Cervantes to A) appoint Dennelle Carrington, HHS Fiscal Director, as the Local Governmental Agency LGA Coordinator for Inyo County for the purpose of coordinating Medi-Cal Administrative Activities (MAAA)/Targeted Case management (TCM) activities, with the California Dept. of Health Services, effective June 28, 2007; and B) reaffirm that the MAA/TCM funds earned be used to support the programs which earn the funds. Motion carried unanimously.

Integ. Waste/Dust Mitigation for Lone Pine Landfill

The Board and Deputy County Administrator, Mr. Chuck Hamilton, discussed Staff’s recommendation regarding dust mitigation measures at the Lone Pine Landfill. Mr. Hamilton reiterated that it was going to take a combination of products to control the dust and that today’s recommendation is to cover about 18 acres of the site. The vendor for the recommended product, Mr. Bill Peek, provided additional information regarding the product, explaining that this is a synthetic polymer which is the only product of its kind to be considered environmentally acceptable and approved by the EPA. The Board and Staff briefly discussed the application process and the impact of dust generated from other nearby locations. Moved by Supervisor Cervantes and seconded by Supervisor Arcularius to A) authorize Integrated Waste Management to schedule dust control treatment at the Lone Pine Landfill and B) authorize a purchase order to Peek Communications in an amount not to exceed $39,688.80 for the dust control treatment. Motion carried unanimously.

 

BofS/Multi- Jurisdictional Group

The Board and Staff discussed the request by the Amargosa Conservancy for the Board of Supervisors to approve an MOU that provides representatives of Inyo County to meet with representatives of San Bernardino County, Nye County and Clark County to discuss important issues such as water, land use, and transportation that affect the desert area shared by the four counties. Several Board Members expressed a desire to see a membership list for the Conservancy. The Board also expressed a desire to have more information and further clarification regarding the scope of the group, the budgeting for staff support, as well as the need to talk with the Water Department and Mr. Greg James regarding this recommendation. The Board directed Staff to schedule a workshop on this item for sometime in the future.

 

District/So. Inyo Fire Protection

Moved by Supervisor Cervantes and seconded by Supervisor Cash to leave vacant a seat on the District’s Board until the November 6, 2007 election. Motion carried unanimously.

 

Board Members and Staff Reports

The Board Members reported on their activities during the preceding week, including reports on the Tri County Fair, an announcement that U.S. Fish and Wildlife will be holding a meeting at the Tri County Fairgrounds on October 11, 2007, on the Big Horn Sheep critical habitat designations in the Eastern Sierra, legislative updates, and various constituent and staff meetings. During the reports, the Board asked that a thank you letter be sent to Ms. Nancy Upham of the U.S. Forest Service for the update on Bishop Pass and Shepherds Pass and that letters supporting the full funding for PILT and Secured Rural Schools funding be sent to our legislators.

 

Closed Session

The Chairperson recessed open session at 10:00 a.m., to convene in closed session, with all Board Members, present to consider Agenda Item No. 7. CONFERENCE WITH LEGAL COUNSEL EXISTING LITIGATION (Pursuant to Government Code §54956.9(a) – Sierra Club v. City of Los Angeles Department of Water and Power, Inyo County Superior Court Case No. CVPT-05-347969 (III).

 

Report on Closed Session

The Chairperson recessed closed session at 10:30 a.m., to reconvene in open session, to receive a report on closed session. County Counsel reported there were no items discussed in closed session, which were required by law to be reported on in open session.

 

Adjournment

The Chairperson adjourned the regular meeting at 10:25 a.m., to 9:00 a.m., Tuesday, September 11, 2007, in the Board of Supervisors Room, at the County Administrative Center, in Independence.
