Board of Supervisors

 

October 2, 2007

The Board of Supervisors of the County of Inyo, State of California, met in regular session at the hour of 9:00 a.m., on Tuesday, October 2, 2007, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Jim Bilyeu presiding, Linda Arcularius, Susan Cash, Beverly Brown, and Richard Cervantes. Supervisor Bilyeu provided the Invocation, and Supervisor Brown led the Pledge of Allegiance.

Public Comment

The Chairperson announced the public comment period and there was no one from the public wishing to address the Board.

 

County Dept. Reports

The Chairperson announced the County Department Report period and Mr. Pat Cecil, Planning Director, reported on a meeting he had attended regarding the West Mojave Plan habitat.

 

Introductions

Ms. Leslie Chapman, Auditor-Controller, introduced Ms. Joey Peterson, Account Clerk and Ms. Mauvra Jacobs, Payroll Technician, in the Auditor’s Office to the Board.

HHS-HIV/MOU Sierra Health Resources

Moved by Supervisor Arcularius and seconded by Supervisor Cash to ratify and approve the Memorandum of Understanding between the County of Inyo and Sierra Health Resources, Inc. for the purpose of assisting Inyo County HIV positive clients in accessing Housing Opportunities for People with AIDS (HOPWA) assistance for short term emergency financial assistance with rent, mortgage or essential utilities, for the period of July 1, 2007 through June 30, 2010 and authorize the Chairperson to sign. Motion carried unanimously.

 

HHS-Hlth. Serv./ CMS Plan

Moved by Supervisor Arcularius and seconded by Supervisor Cash to approve the 2007-08 Children’s Medical Services (CMS) Plan and authorize the Chairperson to sign the Certification Statements. Motion carried unanimously.

 

Fish & Game/ Aeration Project Funding

Moved by Supervisor Cash and seconded by Supervisor Cervantes to approve an expenditure from the Fish and Game Fine Fund to the Hot Creek Hatchery Foundation for one-half the cost of replacing the aeration system at Junction Reservoir in an amount not to exceed $2,750. Motion carried unanimously.

 

BofS/Minute Approval

Moved by Supervisor Cervantes and seconded by Supervisor Arcularius to approve the minutes of the September 18, 2007, Board of Supervisors Meeting. Motion carried unanimously.

 

Workshop/LTWA and Town Water Systems

The Chairperson recessed open session at 9:10 a.m., to convene, with all Board Members present, in a workshop with representatives of the Public Works Department and the Water Department to receive an overview of the Long Term Water Agreement in relation to the transfer of the water systems for the towns of Independence, Laws and Lone Pine from LADWP to the County of Inyo. The Chairperson recessed the workshop at 11:10 a.m., to reconvene in open session at 11:25 a.m., with all Board Members present.

 

Ord. 1130/Work Release Alt. Program

On a motion by Supervisor Cash and a second by Supervisor Arcularius, Ordinance No. 1130 entitled “An Ordinance of the Board of Supervisors, County of Inyo, State of California Adding Chapter 1.25 to the Inyo County Code Establishing the Work Release Alternative Program (WRAP) for Persons Committed to the Inyo County Jail,” was adopted: motion unanimously passed and adopted.

 

Workshop/Four County MOU for Southeastern County Issues

The Chairperson recessed open session at 11:30 a.m., to convene in a workshop concerning the request by the Amargosa Conservancy that the County approve an MOU which provides that representatives of Inyo County will meet periodically with representatives of San Bernardino County, Nye County and Clark County to discuss important issues such as water, land use, and transportation that affect the desert area shared by the four counties. The Chairperson recessed the workshop at 12:10 a.m., to reconvene in open session, with all Board Members present.

 

BofS/Four County MOU for Southeastern County Issues

Mr. Greg James and Mr. Brian Brown, of the Amargosa Conservancy provided additional information and further clarification regarding the MOU between Inyo and San Bernardino counties in California and Clark and Nye counties in Nevada. The discussions included costs to participate, the level of participation, the mission and goals of the group, the ability of the Fifth District Supervisor to meet with the other parties to seek answers to the Board’s questions, as well as a possible conflict in Mr. James’ involvement. Mr. James clarified that it was never the intention of the Conservancy to be involved in the MOU group’s activities. The Board, Mr. Brown and Mr. James continued to discuss the formation of this MOU group, with the Board requesting that Supervisor Cervantes meet with representatives of the other jurisdictions to ascertain the expectations of those entities regarding this MOU, and report back to the Board in the future. Moved by Supervisor Arcularius and seconded by Supervisor Cash to ask Supervisor Cervantes to take the lead to work with the other jurisdictions regarding an MOU between the Inyo County, San Bernardino County, Clark County and Nye County, which provides that representatives of the counties meet periodically to discuss important issues such as water, and use, and transportation that affect the desert area shared by the four counties, and report back on their interests and expectations of this group.

 

Recess/ Reconvene

The Chairperson recessed the regular meeting at 12:30 p.m., to reconvene at 1:30 p.m., with all Board Members present.

 

Board Members and Staff Reports

The Board Members reported on their activities during the preceding week, including an LTC meeting, a Mental Health Advisory Board Meeting, a City/County Liaison Meeting, a COG and ESTA Meeting, Inyo Associates, RCRC Annual Conference Report, a City of Bishop Planning Commission Meeting, IFAS End Users Training Session, the California Low Cost Auto Insurance Meeting, a First Five Commission Meeting, an IMAAA Meeting, a Great Basin Board Meeting, an Independence Civic Club Meeting, and various constituent meetings.

 

Closed Session

The Chairperson recessed open session at 1:50 p.m., to convene in closed session to discuss and take action as necessary on Agenda Items No. 12. CONFERENCE WITH LEGAL COUNSEL EXISTING LITIGATION (Pursuant to Government Code §54956.9(a) – Sierra Club v. City of Los Angeles Department of Water and Power, Inyo County Superior Court Case No. CVPT-05-347969 (III); No. 13. PERSONNEL (Pursuant to Government Code §54957) – Public Employee Appointment – Title County Administrative Officer; and No. 14. CONFERENCE WITH LABOR NEGOTIATOR (Pursuant to Government Code §54957.6) – Instructions to Negotiators re: wages, salaries and benefits – Employee Organization – Inyo County Probation Peace Officers Association (ICPPOA); Negotiators – CAO Ron Juliff, Labor Relations Administrator Sue Dishion, Chief Probation Officer Jim Moffett, Deputy County Administrator Kevin Carunchio.

 

Report on Closed Session

The Chairperson recessed closed session at 5:30 p.m., to reconvene in open session to receive a report on closed session. County Counsel reported there were no items discussed in closed session, which were required by law to be reported on in open session.

 

Adjournment

The Chairperson adjourned the regular meeting at 5:30 p.m., to 9:00 a.m., Tuesday, October 9, 2007, in the Board of Supervisors Room, at the County Administrative Center, in Independence.
